What it does
The Australian National Registry of Emissions Units Act 2011 (Cth) establishes and governs the Australian National Registry of Emissions Units. The Registry is the central electronic ledger for Australia's carbon markets: it records who holds which emissions units, tracks the creation, transfer, and cancellation of those units, and provides the legal infrastructure for carbon credit trading under Australia's carbon reduction frameworks.
The Act performs three related functions. It creates and maintains the Registry as the legal title system for Australian emissions units. It regulates dealings with Kyoto units and safeguard mechanism credit units, including restrictions designed to meet Australia's international obligations under the Kyoto Protocol. And it provides civil penalties, review mechanisms, and information publication obligations around the Registry.
The Registry was originally established under the Greenhouse Gas Pollution Reduction Act 2009. It was continued in existence under this Act, which commenced in December 2011 alongside the Carbon Credits (Carbon Farming Initiative) Act 2011.
