41Termination of appointment

#### 41 Termination of appointment (1) The Minister may terminate the appointment of an Advisory Council member: (a) for misbehaviour; or (b) if the member: (i) is unable to perform the duties of his or her office because of physical or mental incapacity; or (ii) is absent, except on leave of absence, from 3 consecutive meetings of the Advisory Council; or (iii) fails, without reasonable excuse, to comply with section 39 or 40. (2) The Minister must terminate the appointment of an Advisory Council member if the member: (a) becomes bankrupt; or (b) applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or (c) compounds with his or her creditors; or (d) makes an assignment of his or her remuneration for the benefit of his or her creditors.
