Australia New Zealand Food Standards Code – Standard 2.6.2 – Non-alcoholic beverages and brewed soft drinks

Duties (claims)

• Nutrition content claims for electrolyte drinks are restricted to sugar(s), carbohydrate, energy or presence of prescribed electrolytes, and must comply with Division 4 of Standard 1.2.7 except as modified (2.6.2,15(1)-(2)).

1. Prescribed name is strict

• Selling a product under a prescribed name requires meeting the definition exactly. Example: “A food that is sold as a brewed soft drink must be a brewed soft drink” (2.6.2,6). Labelling a non‑compliant formulation as “brewed soft drink” exposes the brand to enforcement. This is not an aspirational label; it is a compositional requirement.

2. Small package claim exceptions

• Small packages (surface area < 100 cm2) have relaxed presentation options in the Code generally, but 2.6.2,13 imposes an additional obligation where a claim requiring nutrition information pertains to a prescribed electrolyte: the label must still declare average quantity per serving of each prescribed electrolyte in mg or both mg and mmol. Relying on small‑package exemptions without checking the specific 2.6.2 carve‑outs is a frequent operational error.

3. Electrolyte drink claims and osmolality testing

• Health claims and isotonic claims require measurement of average osmolality and precise labelling of that metric if claimed (2.6.2,16(2)(a); 2.6.2,17(2)). 4. Fructose ratio ceiling

• Electrolyte drinks must contain no more than 50% of total carbohydrate as fructose (2.6.2,11(2)(c)). If formulators use multiple carbohydrate sources, they must be able to show the proportion of fructose relative to total carbohydrate. 5. Sodium reporting carve‑out

• Section 2.6.2,12(2)(b)(iii) requires declaration of each prescribed electrolyte present other than sodium, expressed in mg or both mg and mmol, subject to subsection (3). 7. Modified claim rules for electrolytes

8. Fluoride addition tightly constrained

• Added fluoride in packaged water is permitted only where the water is non‑carbonated, contains no sugars/sweeteners/flavourings/other food, total fluoride is 0.6-1.0 mg/L and only specified fluoride compounds are used (2.6.2,4). A producer that adds fluoride to a flavoured or carbonated bottled water will be non‑compliant.

9. Hybrid product risks

• “Non‑alcoholic beverage” excludes brewed soft drinks (2.6.2,2 note 2). 10. Transition window technicalities

• The Amendment History provides transition and post‑transition periods (notably for P1030 and P1063). Units packaged and labelled before the end of the transition period may be sellable in the post‑transition period provided they meet either the old or new Code (see P1063 note). Failing to record packaging dates or misapplying the transition rules can lead to non‑compliant stock being sold after the relevant window closes.

11. “Sugars” redefinition

• The 29 Oct 2024 substitution of the sugars definition expressly excludes D‑allulose (see amendment No. 233). That change alters how sugar ceilings and added sugar claims are calculated. 1. Classify products against the Standard’s definitions

• Map each SKU to the relevant Code definition: packaged water (2.6.2,3), brewed soft drink (2.6.2,2 note 2), fruit drink (2.6.2,7), formulated beverage (2.6.2,2 note 2), electrolyte drink or electrolyte drink base (2.6.2,10 and 2.6.2,11).
• Confirm whether a product sold under a prescribed name meets the Standard’s definition, because “sold as” triggers strict composition duties (2.6.2,6 and 2.6.2,7).

2. Document formulation limits and manage R&D changes

• For electrolyte drinks ensure formulations meet the compositional floor and ceilings: at least 10 mmol/L sodium and between 20 g/L and 100 g/L total of the specified carbohydrate list (dextrose, fructose, glucose syrup, maltodextrin, sucrose) and no more than 50% of total carbohydrate as fructose (2.6.2,11(2)).
• For formulated beverages, ensure fruit and sugar levels do not exceed the ceilings (formulated beverage definition in 2.6.2,2 note 2: no more than 240 mL/L fruit; no more than 75 g/L sugars; no CO2; no caffeine).

  • Sugar profiling by monosaccharide and disaccharide for NIP declarations (2.6.2,12(2)(b)(i)-(ii)).

4. Label drafting and NIP adjustments

• For electrolyte drinks and bases include the prescribed name “Electrolyte drink” (2.6.2,12(1)), the recommended volume and frequency of use (2.6.2,12(2)(a)), and the required NIP declarations per serving and per 100 mL for each monosaccharide and disaccharide present plus prescribed electrolytes other than sodium where applicable (2.6.2,12(2)(b)).

• Restrict nutrition content claims on electrolyte drinks to sugar/carb/energy/presence of electrolytes and ensure compliance with Division 4 of Standard 1.2.7 where applicable (2.6.2,15). If making a claim about a prescribed electrolyte, follow 2.6.2,15(2) format constraints.
• For health claims about rehydration or performance, ensure the product’s average osmolality is in 200-340 mOsmol/kg, and include the mandatory activity timing language “after/during at least 60 minutes or more of strenuous physical activity” with the amount of time expressed numerically (2.6.2,16(2)-(3)). Remember Standard 1.2.7 does not apply to these health claims (2.6.2,16(1)).
• Maintain approvals and sign‑offs for label copy changes, and keep a claims register linking each claim to the supporting laboratory evidence and to the specific Code clause authorising the claim.

6. Small package and transitional stock tracking

• For small packages, implement label templates that include electrolyte declarations in mg or mg/mmol where claims requiring nutrition information refer to prescribed electrolytes (2.6.2,13).
• Track packaging dates and batches to manage transitional windows. For amendments with transition/post‑transition windows (P1030 and P1063), document packaging dates to determine whether stock may be sold during transition or post‑transition periods (see Amendment History table entries and transitional clause summaries).

7. Recordkeeping and audit readiness

• Retain analytical data, batch formulations, label artwork proofs and packaging date evidence. Ensure traceability so that regulators can verify average measures (e.g. osmolality) over representative production samples when claims are made.
• Maintain a map of where the Standard modifies or excludes general Code rules (e.g. RDI prohibition 2.6.2,14) and ensure labels do not include prohibited RDI statements.

8. Consult legal/regulatory advice for non‑standard formulations

• If a product is novel or uses ingredients not expressly mentioned (for example non‑standard sweeteners or rare mineral additives), obtain regulatory advice on whether the product’s composition still qualifies it under a prescribed name or whether additional approvals are needed.

9. Cross‑jurisdictional considerations

• If trading in New Zealand, note that parts of the Code apply in New Zealand under the Food Act 2014 (NZ) as indicated in the Standard’s opening notes; local NZ implementation or guidance should be checked.

10. Update practices after amendments

• Reassess formulations and labels when definitions change (for example the 2024 change to the sugars definition excluding D‑allulose). Confirm whether the new definition changes sugar accounting, claim eligibility or labelling.
