Animal Welfare (Poultry) Regulations 2024

The instrument defines a concise set of operational concepts that drive which obligations hit which operators, and when. Key definitions and their operational consequences are: “laying hen” (females at least 18 weeks old, excluding breeding chickens) and “laying shed” (a building where one or more laying hens are caged for commercial egg production) which trigger Part 2 and Part 3 duties (r 3, r 5, r 14). “Person responsible” is a wide operational node: it includes owner, the day‑to‑day manager, operator of the premises or vehicle, and employers of staff who have custody , the statutory duty bearer for many offences (r 3).

The regulations distinguish three spatial concepts that determine minimum space and related obligations: “floor area” of a cage (technical measurement rules and an express exclusion for portions under 35 cm height), “usable space” (the part of a cage or shed where a hen can move and perform normal postures, excluding nest areas and raised fixtures) and “bird level” (height of the bird’s head when standing normally) (r 6, r 15(1), r 26(1)). The measurement definitions matter because different parts of the instrument impose obligations using those specific concepts: Part 2 uses “floor area” and cage measurements (r 6, r 8-13), Part 3 uses “usable space” and a specified height minimum (r 15), and Part 5 uses “usable space” for shed stocking density contexts (r 26).

Temporal staging is a central design device. The regulations introduce a Part 2 operative period that varies by the year in which cages were first installed, creating a multiyear transitional window for existing cages before full compliance may be required or before certain offences apply (r 3). Part 5 standards (substrate, lighting, ammonia monitoring, beak trimming rules and others) commence later (1 July 2025), providing an initial transition period from the date of publication for these cross‑cutting standards (r 2).

Obligations are technical and prescriptive. The regulations set numeric minima for trough length (10 cm per hen), floor area per hen in various configurations (r 8, r 13, r 15), structural attributes (floor support for forward pointing toes, cage height relative to bird level and a 40 cm minimum for 65% of floor area, door dimensions) and tier arrangements (visibility, removal access and excreta protection) (r 9-12). For commercial sheds they require 55 cm cage height for usable space and per‑hen usable area of 1000 cm2 (single) and 750 cm2 (2 or more) (r 15). The regulations also secure nest space, perches or platforms (15 cm per hen), and access to foraging/scratching areas or outdoor areas (r 16-18).

Operational controls extend beyond physical layout to environmental and husbandry monitoring and intervention. Lighting intensity minima are age‑linked (20 lux for <4 days; 10 lux for ≥4 days) and darkness minima require at least 6 hours total darkness and at least one continuous 4‑hour dark period in every 24 hours, subject to specified exceptions including vet‑supervised disease control (r 24-25). Ammonia concentration in certain commercial sheds must be continuously monitored and promptly reduced if exceeding 15 ppm (r 26). Beak trimming is constrained to specified methods and circumstances, with a 30% maximum beak removal rule and competency/training requirements where hot blade trimming is used (r 27).

Regulatory architecture includes offence and penalty structures, alternative offences and defences (r 7(2), r 13 alternative, r 28-30). The regulations also expressly exclude some parts of the instrument from applying to certain birds or operations (for example, r 22(2) excludes laying hens covered by Parts 2 or 3 from the substrate requirement in r 22).

The regulations identify multiple categories of persons and enterprises that will be the legal duty bearers. The statutory “person responsible” definition (r 3) is broad: owners, persons having care, supervisors, managers or controllers of the premises or vehicles where poultry are located, and employers of staff with custody. Where operations are corporate or multi‑layered, the definition extends to the employer or manager that “owns, uses, manages or controls the place” (r 3). The term “controller” of a laying shed is separately defined and targets owners or lessees of cages and persons with day‑to‑day control (r 6). Those two definitions delineate the persons who can be charged under different provisions.

Commercial poultry producers will be the primary regulated population, subdivided by function:

• Egg producers operating laying sheds. Part 2 applies to “laying sheds” and sets staged obligations for cages depending on installation date (r 3, r 5-13). Controllers of laying sheds are specifically targeted by r 7 and r 13 with bespoke penalties.

• Commercial poultry producers keeping laying hens continually in cages in sheds. Part 3 imposes duties on “persons responsible” for laying hens in such systems to provide usable space, nests, perches and access to scratching or foraging areas or outdoor areas (r 14-18).

• Broiler (meat) producers fall within Part 5’s ammonia and substrate rules to the extent the operations do not meet the specific exclusions in r 26(2). The wording of r 26(2) excludes chickens that meet all three listed conditions (more than 10 days of age; bred/reared for meat production; and kept at specified stocking densities in tunnel or mechanically ventilated sheds) from that regulation, leaving other commercial shed operations captured.

• Duck breeders are directly affected by r 19 which requires breeding ducks to have either reasonable access to water to dip their head or constant access to an appropriate bathing system. There is a limited transitional defence for places that began operations before 1 July 2022 (r 19(2)).

• Any operator of captive poultry housed indoors is affected by firefighting equipment obligations (r 21), substrate obligations (r 22), and outdoor area requirements where an outdoor area is provided (r 23).

Smaller operators and hobbyists are affected differently. The definition of “commercial egg production” is a business that keeps 50 or more chickens for producing eggs for sale (r 3). Part 3 is expressly framed to apply to laying hens kept for commercial poultry production and continually housed in cages in a shed (r 14). Several Part 5 standards apply to “captive poultry” without a numerical threshold (r 20), so small‑scale indoor keepers may still be subject to lighting, darkness and substrate duties. The regulations include specific exemptions and exceptions (for young birds under heat lamps or brooders, for example, r 24-25) that differentiate the operator impacts by bird age and husbandry method.

Persons who carry out on‑farm tasks but do not personally hold a legal interest in the premises may still be within scope if they “have care, supervision, custody or control” at the time of the act or omission, but r 29 provides a statutory defence where another person had actual control and the person charged took reasonable steps to ensure care.

Regulatory costs will therefore be concentrated on commercial producers (particularly those operating cages installed after certain dates or those who must achieve Part 3 standards), while diffuse compliance obligations extend to many indoor keepers through Part 5.

Duties are primarily prescriptive, tied to physical dimensions, behavioural opportunities and environmental parameters. They can be grouped into cage design and construction duties (Part 2), commercial cage stocking and amenity duties (Part 3), species‑specific and cross‑cutting husbandry duties (Parts 4 and 5), and monitoring/response duties.

Cage design and construction (Part 2): Controllers of laying sheds must ensure cages meet a set of prescriptive building and equipment standards. These include water and feed access (each hen must have reasonable access to either a water trough providing 10 cm per hen or at least two cup or nipple drinkers; and food trough space of 10 cm per hen) (r 8); floor support adequate for each forward pointing toe (r 9); cage height exceeding bird level and at least 40 cm for 65% of floor area (r 10); door dimensions (height at least 19 cm, width rules in r 11); and tier arrangements that allow inspection, easy removal, and protection from excreta from higher tiers (r 12). Part 2 also prescribes minimum cage floor areas by number of hens (r 13).

Commercial cage requirements (Part 3): Persons responsible for laying hens kept continually in cages in sheds must ensure usable space is at least 55 cm in height and the usable area is at least 1000 cm2 for a single hen or 750 cm2 per hen for two or more hens (r 15). From point of lay the person responsible must ensure nest access is provided on a per‑hen ratio (1 nest area per 7 hens with space for those chickens or 1 nest area per 120 hens of at least 1 m2) (r 16). Perch or platform length must be at least 15 cm per hen (r 17). Hens must have access to an outdoor area or, alternatively, substrate appropriate for foraging, an abrasive device for claw shortening, and suitable surface area for scratching and foraging (r 18).

Species‑specific duties: Breeding ducks must have either reasonable access to water allowing head submersion or constant access to a bathing system appropriate to the duck that allows full‑body access, wet preening and cleaning eyes and nostrils (r 19). There is a transitional defence for certain pre‑2022 operations valid until 1 July 2032 (r 19(2)).

Cross‑cutting environmental and husbandry duties (Part 5): Persons responsible must maintain appropriate firefighting equipment for indoor housing (r 21), provide appropriate substrate (r 22) except where excluded for laying hens covered by Parts 2 or 3 (r 22(2)), provide outdoor areas with shaded and predator‑minimising shelter, foraging/scratching area and adequate access points (r 23), comply with lighting minima for different ages of birds (r 24), ensure darkness minima on a 24‑hour basis with certain exceptions and vet‑supervised flexibility (r 25), continuously monitor ammonia in specified commercial sheds and reduce it immediately if it exceeds 15 ppm (r 26), and follow narrow limits and techniques for beak trimming (r 27).

Monitoring and remedial duties: The regulations impose continuous monitoring duties for ammonia (r 26(3)) and immediate remedial action if levels exceed 15 ppm (r 26(4)). Lighting and darkness rules require that places are not illuminated for any continuous 24‑hour period (r 24(1)), and have minimum dark periods (r 25(4)). Defences are available in specific circumstances: licensed scientific uses (r 28), when the person responsible was not in control and took reasonable steps to ensure proper care (r 29), and timing defences in relation to Part 2 operative periods (r 30).

Rights are limited in the instrument. The text contains no administrative appeal or review provisions within the regulations themselves; it creates duties and offences, and preserves limited defences. Those charged retain the general criminal law rights available in prosecution (not detailed in the regulations). The regulations also allow a veterinarian to authorise temporary lighting deviations and to provide oversight during disease control (r 24(4), r 25(5)(d)), creating a formal role for veterinary professional judgement in limited exceptions. The statutory structure gives operators the right to rely on the Part 2 operative period as a timing defence for Part 2 offences and, in some situations, for Part 3 offences (r 30).

The regulations set criminal offences with specified monetary penalties. Enforcement is not elaborated by agency in the regulations; the instrument creates offences and penalties to be prosecuted under the Animal Welfare Act framework. The core penalty architecture is as follows.

Graduated and per‑unit fines for Part 2 laying shed offences: Regulation 7 establishes an offence for a controller of a laying shed containing at least one “non‑compliant cage” and prescribes a penalty described as “a fine of $20,000 consisting of a fine of $10,000 and an additional fine of $100 for each non‑compliant cage” (r 7(2)). Regulation 13 contains a similar structured penalty for cages with insufficient floor area: a base fine of $10,000 plus $100 per cage in the laying shed that contains at least one laying hen, again totalling $20,000 (r 13, penalty). These provisions create a per‑unit financial multiplier tied to the number of offending cages in a shed (r 7(2), r 13 penalty text).

Fines for Part 3 and Part 5 duties: Most other specified duties carry fixed fines of $15,000 for contraventions. Examples include usable space and cage height duties (r 15(2)), nest area and perches (r 16-17), access to scratching/foraging or outdoor areas (r 18), breeding duck water/bathing system requirements (r 19(1)), firefighting equipment (r 21), substrate access (r 22(1)), outdoor area features (r 23), lighting and darkness breaches (r 24(1), r 24(2)-(3), r 25(2)-(4)), ammonia monitoring and response (r 26(3)-(4)), and the prohibition on beak trimming except as permitted (r 27(2)). Where a regulation specifies “Penalty for this subregulation: a fine of $15 000”, that is the statutory maximum for that specific contravention.

Alternative offences and overlapping penalty options: Several regulations note alternative offences. For example, r 7(2) lists “Alternative offence: r. 15(2)”, indicating that a single act could potentially be charged under different provisions with different penalty scales. Likewise r 13 lists “Alternative offence: r. 15(2)”. That creates prosecutorial choice and potentially differing penalty exposure depending on charge selection.

Defences reduce enforcement exposure in particular factual circumstances. Regulation 28 provides a statutory defence where poultry are used for licensed scientific purposes with institutional animal ethics approval and humane treatment in accordance with the scientific use code. Regulation 29 permits defence where the person responsible was not in actual control and took “reasonable steps” to ensure proper treatment when custody was in the hands of another. Regulation 30 provides timing defences for offences against Parts 2 and 3 relating to the Part 2 operative period (r 30(1)-(2)). Regulation 19(2) gives a specific transitional defence for breeding ducks kept at places that began operations before 1 July 2022 for contraventions occurring before 1 July 2032.

Operational enforcement implications: The regulations require duties that are verifiable by inspection (physical dimensions, provision of nest areas, perches, trough lengths), continuous monitoring (ammonia) and record‑keeping evidence (veterinarian advice and oversight where exceptions are relied upon, evidence of training and competency for hot blade trimming under r 27(5)). The continuous monitoring duty in r 26(3) and immediate action duty in r 26(4) introduce real‑time operational obligations that will require equipment, data collection and demonstrable response protocols.

The text does not specify administrative penalties, improvement notices, or infringement notice regimes. The expressed penalties are monetary fines that would be enforced through judicial process, unless the Animal Welfare Act supplies an infringement notice procedure external to the regulations. Enforcement discretion resides with prosecuting authorities and regulators under the Act, which is outside the text of these regulations.

The regulations operate as a statutory instrument under the Animal Welfare Act 2002 and thus sit within that parent legislative framework. They repeal the Animal Welfare (Commercial Poultry) Regulations 2008 (r 31), replacing that earlier regulatory regime. They also reference the “scientific use code” when providing a defence for licensed scientific use (r 28), which implies interaction with codes and licensing regimes administered under the Act or related administrative instruments.

Timing interactions: Several provisions reference time. Part 5 only commences on 1 July 2025 (r 2). The Part 2 operative period, defined in r 3, stages the application of Part 2 for laying sheds depending on the year cages were first installed, producing a multi‑year interaction with existing capital stock and any planning or development approvals. Regulation 30 formally links Parts 2 and 3 by providing a defence to charges under Part 3 where the shed is a laying shed and the act or omission occurred during that shed’s Part 2 operative period (r 30(2)). Practically, this allows operators of laying sheds in the transition windows to be shielded from Part 3 prosecutions while Part 2 remains the applicable regulatory regime for their shed.

Regulatory scope and exclusions: Several provisions create carve‑outs that affect interplay with industry standards and other laws. For instance, r 22(2) excludes laying hens to which Part 2 or Part 3 applies from the substrate obligation in r 22(1), placing laying hens inside sheds into the more specific cage regimes rather than the general captive poultry standards. Regulation 26(2) delicately defines the population for ammonia monitoring by excluding chickens that meet all three conditions (more than 10 days of age; bred and managed for meat production; and kept at specified high stocking densities in particular ventilation systems), meaning certain broiler operations are outside r 26 while many other commercial sheds are within it.

Veterinary roles and professional thresholds are embedded in the regulations and thus interact with veterinary practice standards and possibly registration frameworks. For example, temporary lighting exceptions require a veterinarian’s assessment, instruction and oversight (r 24(4)), and hot blade beak trimming requires adherence to veterinary advice and demonstrable competency and training records (r 27(4)-(5)). Those provisions may interact with professional obligations under veterinary registration regimes and codes of practice.

Interaction with workplace health and safety and building/fire regulations: The indoor firefighting equipment duty in r 21 places an obligation on persons responsible for captive poultry to “ensure that appropriate firefighting equipment is maintained for, and accessible from, the place where the poultry are housed.” That duty may interact with state work health and safety obligations, building codes and local government fire safety requirements, though the regulations do not expressly harmonise those regimes; operators will need to coordinate compliance across applicable statutory instruments.

Scientific and research licensing: Regulation 28 makes compliance conditional on licenced scientific establishments holding appropriate licences and approvals, and for animal ethics committee approval under the scientific use code , indicating an interface between agricultural welfare rules and research licensing and animal ethics regimes.

Reform and repeal: The regulations repeal the 2008 commercial poultry regulations (r 31). The regulations thus replace the prior instrument, and any compliance or enforcement processes that relied on the 2008 text must transition to the 2024 requirements.

The compilation table at the end of the instrument records the source and commencement of the new regulations: Animal Welfare (Poultry) Regulations 2024, SL 2024/266, published 11 December 2024. Part 1 (preliminaries) commenced 11 December 2024 (publication day), the remainder of the regulations except Part 5 commenced on 12 December 2024, and Part 5 commences on 1 July 2025 (r 2; compilation table). The regulations expressly repeal the Animal Welfare (Commercial Poultry) Regulations 2008 (r 31).

The instrument itself contains built‑in staged commencement and transition mechanics rather than transitional amendments scattered across multiple amending instruments. The staged Part 2 operative period is itself an internal temporal amendment device: it defines a sunset for the Part 2 regimen that depends on the installation year of the cages, with specific end dates: 30 June 2032 for cages installed on or before 31 December 2011, 30 June 2033 for cages first installed in 2012, 30 June 2034 for cages first installed in 2013, 30 June 2035 for cages first installed in 2014, and 30 June 2036 for cages first installed on or after 1 January 2015 but before 1 July 2022 (r 3, “Part 2 operative period”). That architecture imports a long‑run transition path for existing cage systems, effectively creating multi‑year compliance windows that form part of the statutory design rather than being incidental transitional regulations.

The regulations do not themselves record subsequent amendments, schedules or variation notices; the compilation table is the sole item indicating the instrument's initial publication and staggered commencement dates. Any further legislative amendments after publication would be recorded in the official WA legislation database and are not part of the text supplied.

Because the regulations repeal the 2008 regulations, operators should review the differences between the old instrument and the new requirements to determine whether any transitional compliance steps are necessary, but the new regulations embed their own transitional timelines.

The provided text does not include case law or litigation history. The regulations name no cases and the compilation table contains no judicial decisions. There is no litigation history recorded in the instrument itself. Any prosecutions, challenges to the regulations, judicial review of administrative enforcement decisions, or disputes about the meaning of technical terms such as “usable space”, “floor area”, “reasonable access”, or the application of defences (for example r 29 or the Part 2 operative period in r 30) will arise in the courts only after enforcement action or private litigation commences; such decisions are not provided in the text.

Given the specificity of prescribed measurements and the presence of overlapping offences and alternative charging options (for example r 7 cross‑referencing r 15(2) as an alternative offence), future litigation points to watch may include:

• Interpretation of measurement definitions (bird level, floor area, usable space), particularly where cages include fixtures excluded from measurement (r 6, r 15(1)).

• Application and evidential thresholds for the defences in r 28 (scientific licence and animal ethics committee approval) and r 29 (taking reasonable steps when not in actual control).

• The interplay between Part 2 and Part 3 obligations during Part 2 operative periods (r 30), including whether a shed is a “laying shed” and whether the timing defence applies.

• Competing charging strategies due to alternative offences that expose operators to different penalty structures (fixed $15,000 penalties under r 15(2) vs graduated penalties under r 7 or r 13), which may create prosecutorial choice and constitutional or sentencing issues in contested cases.

• Evidence sufficiency for continuous monitoring and the "immediate action" duty on ammonia (r 26(3)-(4)), which may raise technical disputes about monitoring equipment accuracy, sampling protocols and what constitutes “immediate” remedial action.

• Veterinary oversight exceptions (r 24(4), r 25(5)(d)) where the scope of vet advice, oversight and availability is contested.

None of these litigation avenues are currently represented in the instrument’s text; they are typical categories of dispute that arise from highly prescriptive welfare regulations.

The regulations contain detailed technical rules and several drafting features that create traps for the unwary operator, particularly around definitions, timing defences, measurement rules and exceptions. Key “gotchas” to watch for:

• Definition specificity: “Floor area” excludes any cage area less than 35 cm in height (r 6). That exclusion can materially reduce the counted floor area if cages include sloped or low clearance zones, potentially making cages non‑compliant under r 13 even though gross footprint appears adequate. Conversely, r 8 explicitly includes areas under certain troughs and devices in the floor area calculation, which can have the opposite effect.

• Multiple measurement regimes that differ: Part 2 and Part 3 use different space concepts and minima. Part 2’s floor area minima (r 13) are structured by number of hens in the cage (1000 cm2 for a single hen; 1350 cm2 for two hens; 550 cm2 per hen for three or more), whereas Part 3 requires “usable space” with height at least 55 cm and per‑hen usable area minimums of 1000 cm2 (single) and 750 cm2 per hen (two or more) (r 15). For operators with multiple sheds or mixed operations, determining which standard applies depends on whether the shed is a “laying shed” and whether the Part 2 operative period applies (r 5, r 14, r 30). Misclassifying a shed can expose an operator to different penalties.

• Timing defence complexity: The Part 2 operative period depends on the year the cages were first installed and runs to dates between 30 June 2032 and 30 June 2036 depending on installation year (r 3). That gives long transition windows but also obliges operators to have accurate installation records. A failure to document installation dates may make it difficult to rely on the Part 2 timing defence in r 30. Additionally, r 30(2) provides a defence to Part 3 charges where the act or omission occurs in a shed to which Part 2 applies and during that shed’s Part 2 operative period; misunderstandings of what constitutes a “laying shed” or whether the shed is captured can be costly.

• Alternative offences and different penalty scales: Where an act could be charged under an alternative provision (for example r 7 or r 15(2)), prosecutors may choose the offence with the higher penalty exposure. Operators should be alert to the different penalty constructions , fixed $15,000 fines under many Part 3 or Part 5 provisions versus the graduated $10,000 + $100 per offending cage under certain Part 2 offences (r 7, r 13). Sentence exposure therefore depends on charging choice.

• Continuous monitoring obligations: The ammonia requirement (r 26(3)) requires continuous monitoring in sheds used for commercial poultry production that are within the regulation’s scope. Continuous monitoring implies installation, calibration and data retention for gas monitors. The text does not specify acceptable monitoring devices, sampling protocols or record retention , leaving room for enforcement disputes about method sufficiency.

• Veterinary exception formalities: Where exceptions rely on veterinary judgment (for lighting and disease outbreaks r 24(4), r 25(5)(d)), the veterinarian must not only give an opinion but must provide “instructions and guidance”, oversee and evaluate lighting, and be “able to be contacted” (r 24(4)(c)-(e); r 25(5)(d)). Operators relying on these exceptions should ensure written records of veterinary advice, oversight activities and contactability to avoid losing the exception in enforcement.

• Competency evidence for hot blade beak trimming: Hot blade trimming is permitted only with veterinary advice and where the person is competent and has evidence of training and experience (r 27(4)-(5)). Operators using hot blade trimming must keep documentary evidence of competency, including relevant training certificates and supervisor testimonials, to rely on the exception.

• Exceptions for young birds: Lighting and darkness rules contain multiple carve‑outs for young birds under heat lamps or during pick up day (r 24(2); r 25(2), r 25(5)(b)). Misreading the exceptions could lead to breaches when, for example, a flock is being prepared for transport and the dark period requirements are believed to be inapplicable when they are not.

• Interaction with older regulations and records: The regulations repeal the 2008 instrument (r 31) but do not carry transitional administrative directions for enforcement agencies. Operators transitioning from compliance under the 2008 regulations should not assume prior compliance guarantees compliance with the 2024 rules.

Compliance requires a mix of recordkeeping, physical modifications, monitoring systems, staff training, veterinary engagement and operational protocols. The steps below are practical and grounded in the regulatory text.

1. Map which regime applies to each shed and flock. For each building, determine whether it is a “laying shed” (r 3) and whether the birds are kept for “commercial poultry production” and are “continually housed in cages in a shed” (r 14). If the shed is a laying shed, identify the date the cages were first installed and calculate the Part 2 operative period end date (r 3). That date determines whether Part 2 or Part 3 duties apply and whether r 30 timing defences are available.

2. Maintain accurate installation and operational records. Keep verifiable documentary evidence of cage installation dates, chain of custody, purchase invoices, construction dates, and any modifications. Records will be needed to rely on the Part 2 timing defence (r 30) or to defend against per‑cage graduated fines under r 7 and r 13.

3. Assess and, if necessary, retrofit cage dimensions and equipment. For laying sheds during the Part 2 operative period, ensure each cage meets r 8-12 and r 13 floor area minima. For commercial sheds under Part 3, measure “usable space” and ensure at least 55 cm height and appropriate per‑hen usable area (r 15). Specifically verify compliance with trough length requirements (10 cm per hen or alternate cup/nipple arrangements) (r 8), floor support for toes (r 9), cage height relative to bird level and the 40 cm minimum for at least 65% of floor area (r 10), door dimensions (r 11) and tier arrangements (r 12).

4. Provide nest areas, perches and foraging/scratching access. From point of lay, ensure the cage has the requisite nest areas (1 per 7 hens with space or 1 per 120 hens of at least 1 m2) (r 16), perches/platform length of at least 15 cm per hen (r 17), and outdoor access or an internal substrate/abrasive device and suitable surface area for foraging (r 18). If relying on alternative internal provisions (substrate etc.), ensure the substrate is “appropriate” for the poultry (r 22, r 18).

5. Meet duck bathing standards. For breeding ducks, install bathing systems or water access that allow head dipping or a constant bathing system meeting the full body access, wet preening and nostril/eye cleaning standard (r 19). If operating a place that began before 1 July 2022, note the transitional defence only protects you until 1 July 2032 for contraventions occurring before that date (r 19(2)).

6. Implement environmental monitoring and response systems. For sheds captured by r 26, install continuous ammonia monitoring with alarms and documented response protocols to lower levels to below 15 ppm when exceeded (r 26(3)-(4)). Even where r 26 does not apply, operators should consider routine monitoring as part of risk management. Maintain calibration and maintenance records for monitors to evidence continuous monitoring.

7. Implement lighting and darkness management protocols. Install lighting controls that permit measurement of lux at bird level and that enable mandated dark periods: ensure places are not illuminated for any continuous 24‑hour period (r 24(1)), meet minimum lux levels by age (r 24(2)-(3)), and secure 6 hours total darkness including a continuous 4‑hour dark period every 24 hours (r 25(4)). Document lighting plans, lux measurements, and occasions when vet‑supervised deviations are used; ensure veterinarians provide written instructions and oversight where exceptions are relied upon (r 24(4), r 25(5)(d)).

8. Manage beak trimming practices strictly. Limit beak trimming to the permitted scenarios: infrared trimming in a hatchery within 24 hours before moving from incubator for transport, removing no more than 30% of upper and lower beak (r 27(3)); or hot blade trimming only with veterinary advice addressing harmful pecking, performed by a competent person with documentary evidence of training and experience, and removing no more than 30% (r 27(4)-(5)). Keep training records, vet advice forms, and competency proofs.

9. Provide substrate, outdoor features and firefighting equipment. Where Part 5 applies, ensure captive poultry have appropriate substrate except for laying hens covered by Parts 2 or 3 (r 22(1)-(2)), outdoor areas have shaded and sheltered areas, foraging surfaces and adequate access points (r 23), and indoor housing areas have appropriate firefighting equipment maintained and accessible (r 21).

10. Train staff, document procedures and evidence “reasonable steps”. Given the defence in r 29 for persons not in actual control, employers and nominated responsible persons should document training, supervision arrangements, handover protocols and compliance checklists to demonstrate “reasonable steps” were taken if custody shifts. This includes maintaining records of inspections, corrective actions, veterinary consultations, and staff training logs.

11. Prepare for inspections and prosecutions. Since many duties are verifiable by inspection and continuous monitoring, maintain an easily auditable compliance folder per shed containing dimensional measurements, photographs, monitor logs, vet letters, training certificates and maintenance records. This will be the primary evidence if enforcement action begins.

12. Review interactions with other obligations. Coordinate the new welfare requirements with workplace health and safety, biosecurity, building, local government and environmental obligations. For example, firefighting equipment should meet both r 21 duties and applicable fire safety codes.

Following these steps aligns operations with the prescriptive measurements, monitoring and documentary requirements embedded in the regulations (r 6-27) and preserves the available statutory defences (r 28-30) where relevant.
