Airworthiness Directives 2004 - Revocation and Remaking - Schweizer (Hughes) 269 Series Helicopters

The instrument works with a narrow set of administrative and aviation-maintenance concepts. First, "Airworthiness Directive" is the operative object; ADs are instruments that set mandatory or prescriptive maintenance, inspection, modification, retirement, or replacement measures for specified aircraft types and parts. The Schedule shows the types of regulatory interventions ADs can take: inspection obligations (for example "Battery Support Bracket - Inspection AD/HU 269/14"), replacement or retirement life limits ("Lateral Control Bellcrank (P/N 269A7506) - Replacement AD/HU 269/25 Amdt 1", "Retirement Life - Critical Components AD/HU 269/26 Amdt 16"), torque changes ("Tail Rotor Swashplate Bearing Locknut - Increase in Torque AD/HU 269/66"), modifications and reinforcements ("Alternator Circuit Protection - Modification AD/HU 269/69"), and consolidated directives ("Consolidation of Certain Early Airworthiness Directives - Older Model Hughes AD/HU 269/71").

Second, the instrument uses two procedural devices: revocation and re-making. Revocation removes the previous legal instrument(s) listed. Making, as used here, is the re-creation of those directives "as separate instruments" and "in exactly the same form" as the latest published editions. The combination of revocation plus separate re-making is an administrative housekeeping step that restructures the legal instruments without, per the instrument's note, altering their substantive content.

Third, the instrument demonstrates the use of delegated decision-making. The delegate of CASA (named) exercises subregulatory authority, acting under the cited regulation. The instrument is an example of executive administrative action within a technical regulatory field, employing the power to manage, reissue and organise safety directives.

Fourth, the Schedule illustrates the life-cycle of ADs: many ADs carry amendment numbers (for example, Amdt 8, Amdt 16) showing prior modifications; many are annotated as "CANCELLED", indicating that the AD was previously cancelled but is still listed in the Schedule for revocation and re-making. The instrument therefore engages record-keeping and formalisation of the current statutory landscape for a specific aircraft family.

Finally, there is an implicit interaction with publication practice and legal form. The instrument treats each AD as a distinct legal instrument to be attached and separately available, rather than as parts of an aggregated list. The stated purpose of re-making each AD "as separate instruments" affects how an operator locates, cites and relies on a specific AD.

The immediate and primary affected parties are owners, operators, maintenance organisations, certificated engineers, and other stakeholders responsible for the continued airworthiness of Schweizer (Hughes) 269 series helicopters. The Schedule is explicit: every AD listed refers to the Schweizer (Hughes) 269 series. By re-making the ADs as separate instruments, those persons and organisations that must comply with the ADs will need to consult the re-made individual instruments to determine their obligations.

Secondary affected parties include maintenance record-keepers and safety managers who maintain compliance evidence and operators of affected aircraft who must ensure that any required inspections, replacements, torque changes, life retirements, or modifications are performed. Examples from the Schedule illustrate the scope: ADs addressing "Main Rotor Blade - Inspection", "Fuel Injection Lines - CANCELLED", "Main Rotor Gear Drive Assembly - Inspection and Replacement", "Tail Rotor Assembly - Component Replacement, Inspection and Revised" and "Retirement Life - Critical Components." Each of those categories corresponds to different maintenance activities, parts procurement, labour time, and potentially aircraft downtime.

Regulatory and administrative actors are affected too. The Civil Aviation Safety Authority and its delegates, the registries that publish ADs, and service bulletin publishers will have to update their records to show the revoked instruments and the new separate instruments. The note that the directives are being re-made "in exactly the same form as appears in the latest published edition of the Directive" means that those handling statutory publication must ensure that the published ADs match the latest editions being re-made.

Suppliers and manufacturers of parts for the Schweizer 269 series are also indirectly affected because several ADs listed call for replacement parts, retirement limits or torque changes. For example, ADs referencing specific part numbers, such as "Main Rotor Hub and Shaft Assemblies P/Nos 269A5305 and 269A5305-9 - AD/HU 269/40", identify discrete components that manufacturers and parts suppliers will need to support.

Finally, aviation insurers and lessees may be affected through compliance and airworthiness confirmation processes. The restructuring of ADs into separate instruments can alter how compliance is evidenced in maintenance release documentation and leasing covenants, because the legal citation and the format of the directives change even if the substantive content does not.

This instrument is procedural: it revokes listed ADs and re-makes them as separate instruments in the same form as their latest published editions. The instrument itself does not specify the detailed operational duties; those duties will be contained in the individual re-made ADs that are attached. However, the Schedule titles are informative and indicate the kinds of duties that those re-made ADs will impose. The Schedule includes ADs titled with verbs that correspond to duties: "Inspection", "Replacement", "Modification", "Increase in Torque", "Retirement Life", "Component Replacement", "Inspection and Replacement" and "Removal". Those words indicate the actions that operators and maintenance providers will be obliged to carry out where the attached AD so requires.

The instrument establishes the following concrete legal positions:

• Authority and decision-maker. The instrument is made by a CASA delegate, demonstrating that a delegate holds the power to revoke and remake ADs under subregulation 39.001 (1) of the Civil Aviation Safety Regulations 1998. That is the statutory source cited in the instrument for the delegate's power to act.

• Revocation and substitution. All ADs listed in Schedule 1 are revoked by this instrument and simultaneously re-made as separate instruments and attached. The rights and duties that were previously located in the revoked instruments are preserved by their re-made counterparts, by the instrument's own note that they are re-made "in exactly the same form."

• Content preservation statement. The instrument asserts that the re-made ADs replicate the "latest published edition" of each Directive. Rights and obligations created by those latest published editions are, therefore, preserved in legal form once the re-made ADs are attached.

What the instrument does not do, on its face:

• It does not introduce new technical requirements, because of the explicit statement that each AD is re-made "in exactly the same form as appears in the latest published edition."

• It does not specify penalties, enforcement mechanisms, or operational compliance processes; those will be part of the underlying regulatory regime and the individual ADs themselves, not this revocation/remaking instrument.

In practice, therefore, the duties to inspect, replace, modify, or retire components will be embodied in the separate ADs that the instrument attaches. Rights of operators are limited in the instrument to the legal clarity provided by having each AD as a separate instrument, which may simplify referencing and compliance tracking. The instrument does not confer new positive rights such as exemptions or defences.

The instrument itself is silent on penalties and on the enforcement regime. It expressly relies upon the delegate's power under subregulation 39.001 (1) of the Civil Aviation Safety Regulations 1998 to revoke and remake the ADs, but it does not state any sanction, fine, or enforcement method within its four corners. There is no text in the instrument that prescribes penalties for non-compliance with the re-made ADs, nor does it specify which enforcement body will issue sanctions. The only enforcement-related statement in the instrument is the act of making and revoking instruments under the regulatory power identified.

Consequently, any enforcement and penalty framework applicable to the obligations in the re-made ADs must be sought in the broader Civil Aviation Safety Regulations 1998, in the individual Airworthiness Directives themselves, or in other provisions of aviation law and regulation that are not reproduced in this instrument. The instrument’s structure is administrative and record-oriented: it reorganises legal instruments without articulating enforcement policy.

Operationally this creates a couple of concrete points for affected parties. First, compliance obligations (inspection intervals, replacement timeframes, torque settings, retirement lives) will be contained within the individual AD texts that are attached, and those texts are the operative safety obligations which, in other instruments, typically set mandatory requirements. Second, enforcing non-compliance will require the regulator to rely upon the enforcement powers that exist elsewhere in the aviation regulatory statutory framework, not upon any clause in this revocation/remaking instrument.

Users of this instrument must therefore consult: (a) the attached re-made ADs to identify the specific maintenance or inspection duties; and (b) the Civil Aviation Safety Regulations 1998 and other enforcement instruments to determine the remedies, sanctions or penalty regime that applies to failure to comply. The instrument provides no express temporary tolerances, grace periods, or transitional enforcement arrangements in its text.

This instrument expressly operates under subregulation 39.001 (1) of the Civil Aviation Safety Regulations 1998, and therefore sits inside that statutory regulatory framework. The instrument does not purport to amend or override any other Act or regulation; its declared action is revocation and re-making of specific Airworthiness Directives for the Schweizer (Hughes) 269 series.

Interaction points that derive from the instrument’s text are as follows:

• Regulatory authority chain. The instrument demonstrates the delegate-based execution of regulatory power. The revocations and re-making are made under the delegable power in the Civil Aviation Safety Regulations 1998. The legal effect of an AD, once re-made and attached, is governed by the broader CASR regime and any legislative enforcement provisions that give effect to ADs as mandatory safety instruments.

• Publication and legal form. By re-making each Directive "as separate instruments" and in the form of the "latest published edition", the instrument alters the statutory referencing of the relevant requirements. Where previously obligations might have been embodied in a single aggregated instrument or older issued form, the obligations are now intended to be located in separately identifiable instruments. This can affect cross-references in maintenance manuals, contracts, aircraft registry notations, and compliance certificates that point to particular AD numbers and edition dates.

• Prior amendments and cancellations. The Schedule records numerous amendment numbers and cancellation flags (for example, many entries are annotated "CANCELLED" and others as "Amdt 1" through "Amdt 16"). Those editorial annotations reflect a history of regulatory interaction with those ADs. The instrument’s note that re-making reproduces the latest published edition means those amendment decisions and cancellations are integrated into the re-made instruments. This instrument therefore functions as a consolidation and formal publication act within the corpus of aviation safety law.

• No express interplay with non-aviation statutes. The text does not claim or describe any interaction with laws outside the aviation safety regulatory framework, such as contracts, tort, or coronial jurisdiction. Any cross-domain legal effects, for example on contracts that incorporate ADs by reference, will arise through standard legal mechanisms rather than through any express provision in the instrument.

• Record-keeping and compliance documentation. The move to separate instruments will affect administrative interactions with other legal duties, such as continuing airworthiness records or leasing covenants, by changing how the legal obligations are cited and accessed. Those interactions will be practical rather than legislative: maintenance release records, logbooks, and certificate documentation may need to reference the new re-made AD instruments and edition dates.

In sum, this instrument effects a structural and publication-level interaction within the Civil Aviation Safety Regulations framework. It does not itself create cross-cutting legal exceptions or new statutory overlays; its interactions with other laws occur via the established operation of ADs and the broader CASR enforcement mechanisms.

The instrument is dated 20 December 2004 and is framed as a revocation and re-making exercise. Its internal note declares that the separate Airworthiness Directives are being re-made "in exactly the same form as appears in the latest published edition of the Directive." The Schedule reveals that many of the ADs listed have previously undergone amendments; amendment markings in the Schedule include "Amdt 1" through "Amdt 16" depending on the AD. For example, "Retirement Life - Critical Components AD/HU 269/26 Amdt 16" identifies an AD that has had sixteen amendments at the point of the Schedule.

The Schedule also shows items annotated "CANCELLED". Those entries indicate some ADs have been previously cancelled prior to this revocation/remaking instrument. The presence of both "CANCELLED" marks and amendment numbers in the same Schedule suggests the revocation and re-making exercise reconciles a mixed population of active, amended, and cancelled ADs into an administratively consistent set of separately issued instruments.

Because the instrument states that each attached AD replicates the latest published edition, the amendment history that matters for operational compliance is captured in those latest editions. The instrument does not itself list the textual content of those amendments; it simply records the AD title and AD number plus relevant editorial annotations. Therefore, the legal amendment history that affects an operator’s duties is preserved in the attached re-made ADs and their edition dates, not in the revocation instrument alone.

This instrument replaces the previous legal instrument form for each AD, but not the substance. It is an administrative act to ensure each AD is a separable legal instrument reflecting its latest published edition. The Schedule demonstrates that the AD population has a long amendment history for many items (for example multiple "Amdt" entries), and that some have been cancelled; the re-making is intended to generate a set of separately available instruments representing the current state of play as of the latest published editions.

There is no further amendment recorded in this text beyond the act of revocation and re-making. Any future changes to the content of a re-made AD would occur through new amendment instruments or new ADs issued under the governing regulation.

This instrument does not record any litigation history. There are no references to cases, proceedings, judicial reviews, or disputes within the text. The instrument is a formal administrative act by a CASA delegate and the Schedule lists instrument titles and numbers; it does not mention any litigation, nor does it reference any adjudicative outcomes or court decisions.

Because the instrument is an administrative revocation and remake of existing ADs, any litigation that pertains to the content or enforcement of the underlying ADs would be recorded, if at all, outside this instrument in case law reports or in separate records of judicial or administrative proceedings. None of those materials are included in the provided text. Therefore, as far as this instrument itself is concerned, there is no litigation history to summarise.

Practically, affected parties seeking to understand potential legal disputes should note that the instrument preserves the substantive content of the latest published AD editions by re-making them. Any legal challenge to an AD’s substance or an enforcement action founded on an AD would therefore need to address the text of the re-made AD and the statutory powers under which it was issued, namely subregulation 39.001 (1) of the Civil Aviation Safety Regulations 1998. This instrument contains no account of any prior or pending litigation involving those ADs.

Several practical pitfalls arise from the structure and wording of this instrument. They are not legal conclusions but are implicit operational risks and points where misreading the instrument could produce compliance gaps.

1. Confusion from "CANCELLED" labels. The Schedule contains many AD entries annotated "CANCELLED" (for example "Rod End Bearings - CANCELLED AD/HU 269/1", "Belt Drive Idler Pulley Bearing - CANCELLED AD/HU 269/13 Amdt 1"). Because the instrument revokes and re-makes the listed ADs "in exactly the same form as appears in the latest published edition", readers might misinterpret a "CANCELLED" annotation as meaning there is no operative AD. The presence in the Schedule implies that even previously cancelled ADs are part of the revocation/remaking exercise. Operators must therefore check the attached re-made instruments rather than rely on the Schedule's shorthand annotations alone.

2. Separate instruments change referencing practice. The move to make each AD a separate instrument affects how obligations are cited in maintenance records, manuals, and contracts. Maintenance entries and compliance certificates must refer to the correct AD number and edition of the re-made instrument. Failure to update references can cause apparent non-compliance even where the substantive action was done.

3. The instrument does not include AD texts in the body provided. The revocation/remaking instrument lists titles and AD numbers and states attachments replicate latest editions, but the provided text here does not reproduce those attachments. An operator or advisor reading this instrument only must therefore obtain the attached re-made ADs to determine the exact requirements, intervals, and compliance methods. Assuming content from the titles alone (for example inferring inspection intervals) is risky.

4. Amendment numbering indicates a complex pedigree. Several ADs carry high amendment numbers (for example "Amdt 16"). Those ADs may incorporate a complex sequence of technical changes. Treating the re-made AD as a simple, unchanged directive because the instrument preserves content could mislead if an operator is relying on an earlier edition that they possess. Always check edition date.

5. No enforcement or transitional policy stated here. The instrument contains no statement about transitional compliance deadlines or enforcement discretion related to the republishing. If operators assume that republishing grants a grace period or changes compliance deadlines, that assumption will be unsupported by the text. Compliance obligations arise from the re-made ADs and from applicable regulatory enforcement provisions, none of which are adjusted here.

6. Potential duplication risk. Because the instrument revokes and re-makes ADs, but does not list the contents inline, there is a risk that multiple forms of the same AD may remain accessible in various registries (old versions, service bulletins, industry summaries). Operators should confirm which document is the operative re-made AD and its publication date.

7. Reliance on delegate action. The instrument is made by a named delegate under subregulation 39.001 (1). Where parties need to challenge scope or validity, the avenue for challenge will be through the underlying regulatory regime and judicial review of delegated acts. This instrument does not itself provide procedural rights or appeal processes.

Those working with the Schweizer (Hughes) 269 ADs should therefore treat this instrument as an administrative reorganisation and verify the attached re-made ADs, their edition dates, and the applicable enforcement provisions in CASR and other aviation regulatory instruments. Do not rely on the Schedule titles alone to determine specific maintenance actions or compliance timelines.

Compliance requires a two-step approach: identify the operative re-made AD texts, then perform the technical actions required by those ADs. The instrument provides procedural direction: it revokes the listed ADs and re-makes them as separate instruments in the form of the "latest published edition". Therefore, the immediate compliance task is documentary and administrative as well as technical.

1. Obtain the re-made ADs. The instrument says each AD is re-made and attached in exactly the same form as the latest published edition. To know specific duties, obtain the attached AD instruments or retrieve the latest published editions from the Civil Aviation Safety Authority publications or the official AD registry. Do not rely on the Schedule headings alone.

2. Match ADs to aircraft and parts. The Schedule lists AD numbers and titles such as "Main Rotor Gear Drive Assembly - Inspection and Replacement AD/HU 269/23 Amdt 8" and "Tail Rotor Assembly - Component Replacement, Inspection and Revised AD/HU 269/64 Amdt 1". For each Schweizer (Hughes) 269 aircraft in your fleet, cross-check the AD number and the part numbers listed in the AD text to determine applicability.

3. Record the applicable actions. Many ADs in the Schedule indicate inspections, replacements, torque increases, retirements, or modifications. Once the operative AD text is obtained, record the required actions in aircraft maintenance records, including the AD number, edition date, effective date, required interval, and the signature of the certifying maintenance engineer.

4. Plan and schedule the work. Several ADs will impose part-specific tasks that may require lead time for parts procurement, engineering approvals, or scheduled downtime. Examples in the Schedule include component replacements, retirement lives of critical components, and inspections for corrosion. Plan for parts, tooling, and certified personnel to perform the mandated tasks within the AD time limits.

5. Update maintenance manuals and contract references. Because the instrument reorganises ADs into separate instruments, update any manuals, maintenance control documentation, leases, or contracts that incorporate ADs by reference so they cite the correct re-made AD number and edition date.

6. Maintain compliance evidence. After performing work required by a re-made AD, document the work in the aircraft logbook or maintenance release, citing the specific re-made AD instrument and edition, the method used, the parts installed (including P/Ns), and the certifying engineer’s details. This is essential for airworthiness evidence and any regulatory audit.

7. Verify whether "CANCELLED" entries affect obligations. Some entries in the Schedule are marked "CANCELLED". Do not assume cancelled means no requirement remains without checking the attached re-made AD. The instrument’s structure means cancelled annotations may be present for record reasons; the operative text determines whether any action is required.

8. Monitor for subsequent amendments. The Schedule shows that many ADs have prior amendments. After implementing the current re-made ADs, monitor for any future AD amendments or revocations because those will change obligations. Ensure subscription to CASA AD update services or equivalent registries for timely notice.

9. Seek technical clarification when needed. If an AD’s technical requirement is unclear (for example ambiguous torque values, part numbers, or inspection criteria), obtain clarification from the CASA delegate or the manufacturer service bulletin referenced in the AD. The revocation/remaking instrument does not provide technical explanatory material.

10. Confirm enforcement implications. Because this instrument does not state enforcement mechanics, consult the Civil Aviation Safety Regulations 1998 and the relevant enforcement guidance to understand the consequences of non-compliance and any reporting obligations or occurrences that must be notified.

Following these steps aligns operational practice with the administrative change effected by this instrument: it preserves the substantive safety obligations by making them separately accessible and requires operators and maintainers to treat the re-made ADs as the authoritative instruments for compliance.
