#### 1 Name of Act and construction 1 Name of Act and construction > > (1) This Act may be cited as the [Air Transport Act 1964](/view/html/inforce/current/act-1964-036). > > > (2) This Act shall be read and construed subject to the [Commonwealth of Australia Constitution Act](http://www.legislation.gov.au/) and so as not to exceed the legislative power of the State, to the intent that where any provision of this Act or the application thereof to any person or circumstance is held invalid, the remainder of this Act and the application of the provision to other persons or circumstances shall not be affected. > > > (3)–(5) (Repealed) > > **s 1:** Am 1980 No 148, Sch 2 (2).
