76Taking evidence on oath or affirmation

#### 76 Taking evidence on oath or affirmation (1) At the hearing of a proceeding or a directions hearing in relation to a proceeding: (a) the Tribunal may require a person appearing before the Tribunal to give evidence to take an oath or make an affirmation; and (b) a member or a staff member may administer an oath or affirmation to the person. > Note 1: Failure to take an oath or make an affirmation is an offence (see section 117). > Note 2: The hearing is a judicial proceeding for the purposes of Part III of the Crimes Act 1914, which creates various offences in relation to such proceedings. (2) The oath or affirmation is an oath or affirmation that the evidence the person will give will be true. (3) The Tribunal may allow a person appearing before the Tribunal at the hearing of a proceeding, or a directions hearing in relation to a proceeding, who has taken an oath or made an affirmation, to give evidence by tendering a written statement and verifying it by oath or affirmation. > Note: A person might commit an offence if the person provides false or misleading evidence (see section 118).
