What it does
This Airworthiness Directive (AD/DA40/9, 2/2009) mandates inspection and reporting for a defined set of Diamond DA40 aeroplanes to detect voids in the adhesive joint between the wing main spar caps and the upper wing skin. Mechanically, it imposes three immediate obligations on owners/operators of the affected aircraft: (1) carry out the prescribed inspection in accordance with Diamond Aircraft Industries GmbH Mandatory Service Bulletin MSB-40-060 / MSB-F4-016 dated 20 October 2008, or a later EASA-approved revision; (2) report the inspection results to Diamond in accordance with the instructions in that same service bulletin; and (3) where the inspection reveals voids exceeding the criteria in the Requirement document, contact Diamond for approved repair instructions and accomplish that repair before further flight (Requirement section).
The AD sets firm timeframes for those obligations. The inspection must be completed within either 100 flight hours or three months after 12 February 2009, whichever occurs first, and reporting is required within 30 days after the inspection is accomplished (Compliance section). The AD became effective on 12 February 2009 and was issued on 18 December 2008 by David Punshon, Delegate of the Civil Aviation Safety Authority (signature block). The directive incorporates by reference the Diamond MSB dated 20 October 2008 and accepts later revisions only if they are EASA-approved (Requirement). The AD also specifically refers to EASA AD 2008-0224 (Note).
In practical effect, the AD compels a targeted inspection regime for a defined group of serial-numbered DA40s, requires flow of inspection data from operators to the manufacturer, and legally conditions further flight on remedial action if defects exceed the established criteria. Aircraft with voids within the inspection criteria may continue to operate without restriction pending the outcome of ongoing investigations (Background). The AD does not itself set out a schedule of penalties in the text provided; it imposes mandatory actions and timelines that become enforceable under the airworthiness regulatory framework.
