What it does
This instrument, the Aboriginal Land Grant (Jervis Bay Territory) Regulation 2016, does three discrete legal things as made on 28 September 2016 and registered to commence the day after registration (recorded as 5 October 2016 in the commencement table). First, it formally establishes the regulation by name (s 1). Second, it fixes commencement arrangements, including a table specifying that the whole instrument commenced the day after registration, with the specific commencement date noted (s 2(1) and the accompanying commencement table and note). Third, it sets out the legal authority under which it is made and the limited substantive content that it prescribes: the regulation is made under the Aboriginal Land Grant (Jervis Bay Territory) Act 1986 (s 3), it declares how Schedules operate (s 4), it supplies two short definitions (s 5), and most consequentially it prescribes maximum penalties for breaches of particular provisions of the Aboriginal Land Grant (Jervis Bay Territory) By‑Laws 2016 (the By‑Laws) by reference (s 6 and the Penalties table).
Mechanically, the regulation does not itself create the substantive criminal or regulatory offences; instead it operates as a companion instrument that fixes maximum punishments for offences contained in the separate By‑Laws instrument. Section 5 defines the terms used in the regulation: “Act” means the Aboriginal Land Grant (Jervis Bay Territory) Act 1986 and “By‑Laws” means the Aboriginal Land Grant (Jervis Bay Territory) By‑Laws 2016. Section 6 expressly frames the penalty schedule “for the purposes of subsection 52A(7) of the Act”, and then lists 74 items linking specific By‑Laws subsections to maximum penalties expressed in penalty units and, in many entries, distinguishing between natural persons and corporations.
Finally, Schedule 1 effects a repeal: it repeals the whole of the Aboriginal Land Grant (Jervis Bay Territory) Regulations 2006 (Schedule 1,Repeals). Section 4 provides the mechanism for schedules to amend or repeal instruments specified in them, so the 2006 Regulations are expressly removed by this instrument as enacted. The instrument therefore operates as a narrowly tailored regulatory vehicle: it names the new By‑Laws’ penalty maxima, defines the operative terms as between the Act and the By‑Laws, and removes the predecessor Regulations.
