sec.24 Land that is available State land—general

Land is available State land if it is— land, other than excluded land, in which no person other than the State has an interest; or land, other than excluded land, that is subject to an interest granted by the State, if an available State land agreement is in force for the land; or land inside the Torres Strait area that is land— in which no person other than the State has an interest; and declared under a regulation to be available State land. Subsection (1) is subject to sections 26 and 27 . In this section— interest means a legal or equitable interest in the land but does not include native title, a mining interest or an easement. s 24 amd 1991 No. 76 s 5 ; 1993 No. 85 s 160G (amd 1994 No. 61 s 2 sch 2 ); 1995 No. 57 s 4 sch 1 ; 2008 No. 29 s 14 sub 2011 No. 26 s 25 (sec.24-ssec.1) Land is available State land if it is— land, other than excluded land, in which no person other than the State has an interest; or land, other than excluded land, that is subject to an interest granted by the State, if an available State land agreement is in force for the land; or land inside the Torres Strait area that is land— in which no person other than the State has an interest; and declared under a regulation to be available State land. (sec.24-ssec.2) Subsection (1) is subject to sections 26 and 27 . (sec.24-ssec.3) In this section— interest means a legal or equitable interest in the land but does not include native title, a mining interest or an easement.

• (a) land, other than excluded land, in which no person other than the State has an interest; or
• (b) land, other than excluded land, that is subject to an interest granted by the State, if an available State land agreement is in force for the land; or
• (c) land inside the Torres Strait area that is land— (i) in which no person other than the State has an interest; and (ii) declared under a regulation to be available State land.
