Original judgment source is linked above.
(1) Reviewed and varied the guardianship order, appointing the Public Guardian for 2 years as the guardian of YNN to make decisions about his accommodation, access to services and the restrictive practices used to manage his behaviour.
(2) Varied the financial management order by revoking the appointment of YPG as YNN's financial manager and committing his affairs to management by the NSWTG.
(1) YNN was asserting that the Tribunal fell into error when it renewed the guardianship order and when it appointed the Public Guardian as the guardian. He also asserted that the Tribunal fell into error when it varied the financial management order and committed his affairs to management by the NSWTG.
(2) YPG was asserting error of law only in respect of the decision that she was not a suitable person to be appointed as guardian for YNN and the resultant appointment of the Public Guardian.
(1) The length of the delay is relatively short and there would be no prejudice to the other parties to the appeals if the discretion to extend time to appeal were to be exercised.
(2) The Reasons indicate that YNN has a disability, and in the Notice of Appeal he indicates that he needed the assistance of his (previously absent) sister to complete the Notice.
(3) English is not YNN's first language, and an interpreter assisted at the review proceedings and in the appeal hearing. We accept that it is likely that YNN experienced some difficulty completing the Notice of Appeal due in part to language difficulties.
(1) He was not provided with a reasonable opportunity to be heard in the review proceedings.
(2) The Tribunal failed to consider "the notice provided by YPG regarding what YNN's NDIS Support Coordinator was doing for YNN".
(3) He was not provided with an adequate interpreter service.
Was YNN provided with a reasonable opportunity to be heard in the review proceedings?
Did the Tribunal fail to consider "the notice provided by YPG regarding what YNN's NDIS Support Coordinator was doing for YNN"?
Did the Tribunal fail to provide an adequate interpreter service for YNN?
"Whether or not inadequate translation or interpretation means that a hearing is not fair will depend ultimately on the particular circumstances of the case."
"[A] claimant must be provided with a standard of interpretation such that he is afforded a meaningful opportunity to communicate his claims, evidence and submissions to a decision-maker and a meaningful opportunity to respond to that which a decision-maker may wish to say".
(1) Interpretation was provided by an interpreter in the Arabic language provided by Multicultural NSW, who affirmed that she would conduct the interpretation honestly and sincerely.
(2) The Senior Member explained the role of the interpreter to YNN, including that the role of the interpreter was to "interpret, not to clarify" (Tcpt, p 8(6)) and if he had a question he should direct it to the Senior Member, not to the interpreter (Tcpt, p 8(1)).
(3) The Senior member advised participants to use short sentences to allow for the interpreter to interpret and that "sometimes people get excited and want to tell a long story, but it's very hard for the interpreter to interpret": Tcpt, p 8(19-20).
(4) Not every word or phrase was interpreted during the review proceedings.
(5) YNN sometimes responded to questions asked in the English language without waiting for the interpreter and at times responded using the English language. On a number of occasions, the Senior Member advised him to wait for the interpreter.
(6) On at least one occasion the interpreter complained that it was "very hard" to interpret because YNN was "just cutting me": Tcpt, p 18(18).
(1) YPG was asked, and responded, to questions about whether she should be the guardian: Tcpt, p 33(38-44), p 49(20-44), p 50(5-35), p 51(6-16).
(2) YPG gave detailed information alleging that YNN had been inappropriately taken from a support provider to a different provider who was encouraging him to gamble (Tcpt, p 19(7-24)) and that new support providers were misleading YNN about her (Tcpt, p 49(29-39)). YPG proposed that she be appointed as the guardian because she needs to monitor such situations: Tcpt, p 49(29-39).
(3) YNN said that he opposed his sister being appointed as his guardian: Tcpt, p 42(1-10), p 52(1-3).
(4) YPG said that YNN becomes agitated when thinking about her, but she expressed the view that this is because of discord due to her being the financial manager, not because she was his guardian: Tcpt, p 50(16-46), p 51(1-16).
the evidence supplied by my sister, she did not ask to cancle (sic) her guardian (sic), she provided all evidence in her application for public financial managements (sic).
(1) The time for filing the Notice of Appeal is extended to 10 June 2025.
(2) The appeal is dismissed.
(3) Leave to appeal refused.
I hereby certify that this is a true and accurate record of the reasons for decision of the Civil and Administrative Tribunal of New South Wales.
