REASONS FOR DECISION
- This appeal concerns 79-year-old former builder, YJD, who has been diagnosed with dementia.
- On 26 February 2024, the Guardianship Division of the NSW Civil and Administrative Tribunal (NCAT) made a guardianship order in respect of YJD and appointed one of his daughters, YJC, as guardian. On 3 April 2024, the Guardianship Division made a financial management order in respect of YJD and appointed YJC as financial manager.
- YJD's other daughter, YJB, appeals from those decisions. YJB contends that the Tribunal made a series of legal errors and, in addition, seeks leave to appeal. Further, YJB alleges that her sister, following her appointment as their father's guardian and manager and contrary to the undertaking she gave the Tribunal, has attempted to undermine YJB's relationship with their father.
