Judgment
- This is an appeal under s 97 of the Environmental Planning and Assessment Act 1979 (EPA Act) against the refusal of a development application (62/2014) by Burwood Council (council) to demolish existing dwellings and construct a 5 storey residential flat building (RFB) with basement parking at 24A and 26 Gordon Street, Burwood (site).
- A number of the Contentions raised by council in the Further Amended Statement of Facts and Contentions (Exhibit 3) have been resolved through amended plans, further information, conditions and the agreement of the experts. The key issues that remain in dispute are whether: 1. the proposal is compatible with the existing and desired future character of the area; and 2. the proposal will adversely affect the significance of the heritage items in the vicinity.
