Judgment
- The three plaintiffs, Natasha May Vasey, Vanessa Louise Henry and Rachael June Fowler, are the daughters of Stephen James Henry, who died on 28 February 2017.
- The defendant is Dianne Barbara Henry. She is the widow of the deceased.
- Without meaning any disrespect, to avoid confusion and for consistency I will refer to the parties by their first names.
- The plaintiffs' mother is the first wife of the deceased, from whom he was divorced before his death.
- By summons filed on 26 February 2018, the plaintiffs each seek orders pursuant to s 59 of the Succession Act 2006 (NSW) (Succession Act) for further provision for their proper maintenance, education or advancement in life out of the estate or notional estate of the deceased.
- The issues raised by this application are relatively simple, and there was no substantial dispute about the primary facts.
