- For the reasons set out at [307] to [314] above, the Hitler Imputation has caused immense damage to Mr Cripps' personal and professional reputation. Due to the ferocity and wide-ranging attack on Mr Cripps for being a racist and sharing the racist views of Hitler in the First Vakras Article, I have no hesitation in concluding that those reading it who did not know Mr Cripps well would have instantly concluded that he was an odious individual. Accordingly, I find that Mr Cripps' reputation and standing have been grievously injured by the Hitler Imputation.[62]
155 His Honour's failure to correctly identify the gist of the Hitler imputation, the gist as found being outside the pleaded case, and the impact of those matters upon damages would require, even in the absence of any other error, that the appeal against the judgment for damages in favour of Cripps with respect to the two Vakras articles be set aside and a new trial ordered. We would not be prepared to embark upon a new and substantial exercise in fact-finding, particularly as credit issues would require consideration and this Court has not seen or heard the parties or other witnesses.
