Reasons for Decision
- On 11 March 2022 the applicant (the Builder), made an application to the Tribunal for the review of a decision (the Decision) made by the Commissioner for Fair Trading (the Commissioner) on 10 March 2022.
- The Decision took effect from 10 March 2022 and resulted in the Builder's contractor licence being cancelled on the basis that the Builder was guilty of improper conduct and was not a fit and proper person to hold a contractor licence.
- On 24 March 2022 I made directions for the exchange of documents in the substantive application and the matter is listed for final hearing on 20 and 21 June 2022.
- On 10 May 2022 the Builder filed an application seeking an order pursuant to s 44 of the Civil and Administrative Tribunal Act 2013 (NCAT Act) to join Deirdre Webster to these proceeding. The Builder also seeks an order, pursuant to s 30(2) of the NCAT Act or s 63(2) of the Administrative Decisions Review Act 1997 (ADR Act), requiring Ms Webster to give access to her property for the purposes of an inspection by the Builder's expert. If those orders are made, the Builder is also seeking an adjournment of the final hearing to allow for the inspections and expert reports to be prepared. These reasons deal with those interlocutory applications of the Builder.
- On 10 May 2022 I made orders for the parties to provide written submissions addressing the following issues: 1. The legal basis upon which the Tribunal could make orders joining Mrs Webster as a party or make orders for access to the property; and, 2. if relevant, whether the Tribunal should exercise its discretion to make the orders sought.
- Both the Commissioner and Ms Webster object to an order for her to be joined as a party or compelling her to provide access to her property for the purpose of an inspection.
