Reasons for Decision
- These proceedings relate to the applicants' claim for the cost of demolishing and rebuilding their residence at Townsend (the 'residence') which was constructed for them by the respondent. They say that demolition and rebuilding their residence is necessary because, among other things, the residence constructed by the respondent was not fit for purpose as a residential dwelling. The total amount of their claim is $350,167.33.
- The position of the respondent is, if I may summarise it, that while there may be minor defects present and repairs required which form part of routine maintenance, the demolition and rebuilding of the residence is not warranted.
- In these Reasons for Decision I will refer to the applicants as the owners and to the respondent as the builder.
- There is no dispute between the parties that the owners' claim is a building claim for the purposes of the Home Building Act 1989 (the 'Act') and that the Tribunal has the jurisdiction to hear and determine the claim.
- The proceedings were heard in Lismore over 4 days in May and in November 2017.
- Both parties were legally represented. Counsel appeared on their behalf at the hearing.
