Background
- This is an appeal from a decision made in the Consumer & Commercial Division of the Tribunal by which orders were made requiring the Appellants (who were the Respondents at first instance) to "rectify the breach of the statutory warranties in s 18B(1)(b), (c), (e) and (f) of the Home Building Act by removing the Biowood attachments installed on the façade of 3 and 5 XXXX Drive, Ryde NSW, and replacing Biowood attachments with attachments to the external walls that comply with the codes, standards and statutory warranties". In addition, the Tribunal made an order for the Appellants to pay the costs of the Applicant (now the Respondent to this appeal). We will refer to the Applicant as the Respondent.
