Applicants/cross respondents: Lucy Stockton and Morgan Williams
Respondent/cross claimant: self-represented and accompanied by Mr Francica of NF Property Management
(1) sublease part of the Premises to a "friend" on the basis the landlord's refusal is unreasonable; and
(2) keep a small pet dog at the Premises on the basis that the failure to give consent by the landlord is not based on a valid ground under the Act.
Previous conciliations and directions in these proceedings
(1) advertisements to let posted on Airbnb, Flatmate Finders and Facebook
(2) emails and text messages
(3) NSW Fair Trading pet application form dated 15 June 2025 and Alldis & Cox pet application forms signed 13 June 2025
(4) House Rules governing the Company Title Building (House Rules)
(5) four Notices of Termination and previous Tribunal applications
(6) emails from witnesses, being former occupants of the Premises and current residents of the Building.
(1) 31 pages, which I have marked exhibit T1 including:
(a) 1 page of submissions/timeline
(b) subtenancy application form for Jayde Turner-Ledwidge and supporting documents
(c) pet application forms with supporting documents for dogs and emails
(d) photograph of building
(e) internet research on pet policies in strata buildings (undated)
(f) AI research on subletting in NSW (9 April 2025)
(g) 21 June 2025 notice of termination
(h) reference from a former occupant of the Building, doctor's and psychologist's letters, texts from the previous tenant of the Premises; and
(2) approximately 68 pages which have been extracted from the landlord's documents and contain Ms Stockton's handwritten comments, which I have marked exhibit T2.
Additional documents handed up by the landlord at the hearing on 21 October 2025
(1) an email dated 2 October 2025 from a former occupant of the Premises, Charlotte Edwards to Mr Francica;
(2) text message from Maria Klunder, owner of unit 8 and one of the directors of the Company to the landlord, dated 11 October 2025;
(3) updated advertisements to rent two bedrooms at the Premises which were placed on Flatmate Finders in September and October 2025 by "Jayde" as the person moving out.
Additional documents filed by Ms Stockton after the hearing
(1) a one-page letter to the Tribunal addressing the email from former occupant, Charlotte Edwards;
(2) letter from Kim Brill, Safety Action Meeting Coordinator (Eastern Sydney) of the Sydney Women's Domestic Violence Court Advocacy Service dated 28 May [2025];
(3) letter from Ms Stockton's treating psychologist, Dr Sabine Merz of Cambia Psychology dated 3 September 2025; and
(4) AVO/DV Listing date of 30 October 2025 at Waverley Local Court for Morgan Williams in case number [xxx].
(1) The letter from Dr Merz already appears in the tenants' evidence at T1 (p 22).
(2) The next ADVO listing date was attested to orally at the hearing and is information that can be obtained on a public database.
(3) The letter from Sydney Women's Domestic Violence Service has previously been provided to the Agent and owner on 14 June 2025 (L1, p 86).
(4) Ms Stockton's letter to the Tribunal primarily refutes the matters raised in the email from Charlotte Edwards. Given I allowed Ms Edwards' email to be handed up at the hearing, I allowed Ms Stockton to make detailed oral submissions in response. It is a question of which version of events I ultimately prefer.

Legal principles - Residential Tenancies Act and relevant clauses of the tenancy agreement
87C Breach of tenancy agreement
(1) A landlord may give a termination notice on the ground the tenant has breached the residential tenancy agreement.
(1) The termination date must be at least 14 days after the termination notice is given.
(a) the tenant has breached the residential tenancy agreement, and
(b) the breach is, in the circumstances of the case, sufficient to justify termination of the agreement, and
(c) the termination notice was given in accordance with this section, and
(d) the tenant has not vacated the premises as required by the notice.
(a) the nature of the breach,
(b) previous breaches,
(c) steps taken by the tenant to remedy the breach,
(d) steps taken by the landlord about the breach,
(e) the previous history of the tenancy,
(f) another matter the Tribunal considers relevant.
(1) Clause 35
(2) Clause 56
(3) Additional Term - clause 59.2
(4) Special Condition 15 of Schedule A (relating to flats)
(5) Special Lease Conditions concerned with subletting and pets set out in the Annexure
Subletting and unlawful short term/holiday leasing
"The tenant agrees not to use, advertise for use, sub-let, license, transfer or otherwise part with possession of the whole or any part of the residential premises for the purpose of giving a person the right to occupy the residential premises for the purpose of a holiday, without the prior written consent of the landlord, where such consent may be refused in the landlord's absolute discretion."
(a) The tenant must notify the landlord if the tenant changes the existing use of the flat.
(a) Without limiting Special Condition 15(a), the following changes of use must be notified:
...
(i) a change to the use of the flat for short-term or holiday letting.
(a) The notice must be given in writing at least 21 days before the change occurs or a lease or sublease commences.
"Notwithstanding clause 35 of the Residential Tenancy Agreement, the tenant agrees that under no circumstance are they to sub-lease any part of the property without obtaining the written permission of the landlord or landlord's agent. The tenant is not to list the property with any third party, i.e. Airbnb, Flatmates.com.au or similar. Furthermore, the property is not to be sub-leased at any time during the tenancy as a short-term letting or holiday rental."
Except to the extent that another term of this agreement expressly permits the tenant to do so**,** the tenant must not keep, or permit to be kept, any animals on the residential premises.
The tenant acknowledges that no pets are allowed to be kept on the premises [within the lot or common property, this includes any associated balcony, courtyard or garden area] without prior written consent from the landlord or landlord's agent.
Did the tenants make a valid application for consent under s 73C?
Incompetent application - no jurisdiction of Tribunal to hear application under s 73G
"Once the tenant has made a written request, the tenant's right to apply to the Tribunal does not arise until the expiry of 14 days from the date of the request and the landlord having failed to repay the amount requested by that time. That is, the tenant's standing to make an application under s 47(4) does not arise until the requirements of s 47(1) and (3) have been met."
Tribunal application filed before 21 day period expired
"It's a 2 bedroom flat and they were renting out 1 room to me and this couple from Scotland. The couple said they were paying $700 a week and I was paying $500 a week... Lucy and Morgan also came whenever she wanted without informing us. After the couple left, another girl came from Germany. She said she found the place on Airbnb and she paid around $460 for 5 nights... Both Lucy and Morgan weren't living there until this Tuesday. The couple from Scotland said they saw other places advertised by Lucy, so who knows if they are illegally subletting other places, and the places they were housesitting while they weren't living in this place."
"I moved into the property as a tenant under Lucy Stockton...Lucy herself does not live at the property and instead has been renting out rooms while residing elsewhere...I have been subjected to ongoing harassment, verbal abuse and intimidation by my flatmate, Jayde Turner-Ledwidge and her boyfriend, who is not a tenant but is present almost daily. I also pay more rent than Jayde ($400 per week, compared to her approx.$300). In addition Jayde operates a hair salon business from the apartment, hosts frequent overnight guests...I have been forced to contact Police on two occasions, most recently yesterday (30 September) due to jayde and her boyfriend's aggressive and threatening behaviour... Morgan asked Jayde to vacate the property so that the harassment and safety issues would cease."
"Despite reporting these issues multiple times to Lucy, she has failed to act... She has also claimed that Jayde has received a vacate notice, but has not been able to document when or if Jayde will be moving out... Morgan has been the only party to offer meaningful assistance... he... asked Jayde to vacate the property so that the harassment and safety issues would cease."
"I confronted the people who have moved into jubba's property as I trod in dog poo while hanging out clothes. Another time there were 3 large poos in the clothesline area. I also put a letter under their door advising that was communal area including the balcony and they could not allow their dogs to roam freely. It is disgusting. I also met Michael the owner of the apartment and asked if he was attending the meeting." (pp 146-147).
(1) Kaz, a former work colleague, who stayed from early November 2024 to early January 2025. Ms Stockton asked her to leave as she had a large dog.
(2) Puja, a friend of a friend from Canberra, who stayed from mid-January 2025 to 4 February 2025. The tenants asked her to leave due to her lifestyle and drug use and in retaliation Puja made up a story about the tenants advertising on Airbnb to cause trouble. The Scottish couple that Puja mentioned were the tenants' friends from Glasgow.
(3) Jordyn, a friend who moved from New Zealand, who stayed from 8 February 2025 to mid-March. Jordyn was unable to stay as she wanted to bring her cat over from New Zealand and the tenants did not want that.
(4) Rosie, a friend who stayed from April to May 2025.
(5) Jayde Turner-Ledwidge who moved in around 7 June 2025 and to mid-October 2025. Jayde's boyfriend Adam lives around the corner and was never an occupant at any time.
(6) Charlotte Edwards, a friend who stayed from September to October. Charlotte had a falling out with Jayde. Lucy was away at the time and was not sure what happened between them.
"I have been a victim of domestic violence/emotional abused & am currently not living at the property as Morgan has an AVO & was arrested & charged of 2 cases of assault. He is currently on bail until his court case & has to reside at the property as in his bail terms.
I gave him Michael's bank details & he has obviously not been paying the rent... He has also threatened my friend Rosie who is staying there now without me...
[The Police] have given me a form to fill out and bring to you [to] discuss a safe plan of action whether it be removing me from the lease asap or starting a new one since Morgan may or may not get removed from the property."
(1) All of July, as she was in Jindabyne.
(2) Friday and Saturday, 26 and 27 September 2025 as she was looking after a friend's place at Coogee.
(3) From time to time she stayed with Morgan as the terms of the ADVO allowed her to. Under the terms of the ADVO, she is allowed to stay where he is staying, but he cannot stay at the Premises if she is living there.
Findings - landlord's termination application - formalities of notice of termination
Was there a breach by partially subletting without consent?
Was there a breach by short term holiday letting - either partial or entire sublet?
Was there a breach by subletting the whole of the Premises without consent?
Renting out other properties during tenancy as evidence of non occupancy
Was there a breach by attempts to transfer whole tenancy?
Was there a breach by listing the Premises for whole or partial sublet with a third party?
Are the breaches sufficient to justify termination of the tenancy?
Refusal to allow pets based on a ground that is not applicable?
(1) Each of the following has no force or effect to the extent that it would unreasonably prohibit the keeping of an animal on a lot -
(a) a by-law,
(b) a decision by an owners corporation under a by-law.
I hereby certify that this is a true and accurate record of the reasons for decision of the Civil and Administrative Tribunal of New South Wales.
