- These proceedings are not, of course, an appeal by way of a re-hearing of the merits of the council's determination to grant consent to the second respondent's development application. The Court can only determine whether the council's determination was either lawful or unlawful.
- The property known as No. 897 New South Head Road, Rose Bay is within Zone No. 2(a) (Residential "A" zone) under the relevant environmental planning instrument, the Woollahra Local Environmental Plan 1995 ("the LEP"). It is also within the harbour foreshore scenic protection area under the LEP. Development for the purpose of residential dual occupancy is prohibited in Zone No.2(a) under the zoning table in the LEP.
