Judgment (21 paragraphs)
The applicant
- The applicant submitted that the proceedings as against the first respondent should not be dismissed because it had some responsibility in circumstances where he informed Ms Thompson about the water leakage, and she recommended having repairs done, which is what he did.
- The applicant submitted that the proceedings as against the second respondent should not be dismissed because it had some responsibility in circumstances where lot 8 is an apartment, and he could not negotiate with it as he was unable to locate it.
- I indicated to the applicant that I did not need to hear any submissions as to whether the proceedings as against the third respondent should be dismissed.
Whether the Tribunal should dismiss the proceedings as against each of the respondents
