Judgment
- HER HONOUR: On 31 August 2020 the accused, Asalemo Dick AJ Pesamino was arraigned before me on an indictment charging him as follows: Count 1: On 3 May 2018, at Villawood in the State of New South Wales, did murder Brett Nicholls. Count 2: On 3 May 2018, at Villawood in the State of New South Wales, did assault Gregory McDougall, thereby occasioning him actual bodily harm. Count 3: On 27 March 2018, at Villawood in the State of New South Wales, did assault Brett Nicholls, thereby occasioning him actual bodily harm.
- Pleas of not guilty were entered to each of the charges.
- The trial proceeded without a jury. With leave, the accused filed an application in court by which he sought an order that he be tried by a judge alone (MFI 1). The Crown consented to that application, taking no issue with the application having been made out of time. The application was granted and a trial by judge order was made: ss 132 and 132A of the Criminal Procedure Act 1986 (NSW).
