"Thirty months later on the 21st of September 2000 at the St Kilda Road Police Station Mr Pullin looked at the video, Exhibit 12. He said this, 'I asked for no. 5 and no. 8 to be shown again, and then I asked if they could stop the video so I could actually go up and put a clipboard or some paper over the eyes of the person to re-enact the features that I saw in the robbery.'
He then selected no. 8. He said this, 'The jawline and the cheeks and the sunken high cheekbones were most similar to the larger man.' Mr Pullin did not select no. 8 as the robber, all he did was he selected no. 8 as the most similar to the larger man in that video. The reason he went up to no. 8 and put the clipboard over it was because the larger man had dark glasses and a peaked baseball cap on in the Labour Day robbery.
He said the smaller man had a balaclava but just eyeholes and he couldn't see any distinguishing facial features or anything. In relation to the smaller man, he said that he was considerably shorter, probably six inches shorter, up to six inches shorter than the first man. The first man was about six foot, the second man who came in was much thinner, smaller, he was very athletic. 'he was a young athletic person, he was like a jackrabbit'. He said, 'The first offender would have been 40ish and the other one, just by his actions, he looked young, you know, 17 or 18 by his actions'.
...
Mr Pullin was asked this by Mr Dane, 'What height are you?' Answer, 'I'm six foot. The larger man would have been my size, maybe an inch taller at the most.' he said, 'The larger man was no shorter than six foot tall. He had an olive complexion. He wasn't fair. He was clean shaven. He had a cap on his head and dark glasses. The glasses covered from the bridge of the nose upwards, from the top half of his cheek upwards'.
Then the FACE Image of Ms Chadwick, made a couple of days later on 13th of March 1998, was played to him. He said of that FACE Image, 'I didn't have an opportunity to have a good look at the person's hair.' so he couldn't comment on the colour of the hair. He said however this, 'The upper part of the man's cheek is not as prominent as in this FACE Image.' Question, 'What about the nose?' Answer, 'I didn't pay a lot of attention to the nose but it is similar.' Question, 'The mouth?' Answer, 'I don't recall.' Question, 'The jawline?' Answer, 'The jawline was at the depressions of the cheek, cheeks, it was, the face was a little wider, the cheeks were sunken and the jaws a little sharper. The chin wasn't as rounded as that, it was sharper than on the FACE Image.' Question, 'Skin tone?' Answer, 'It was what I would consider a fair complexion. That picture is too fair in colour.' of the larger man he said, 'I consider him to be well-built and muscular, he was broad shouldered. He didn't have a belly. He was a fitter person than myself. He was medium/solid.'
He took Mr Pullin through the couple of frights that he got in the three months later, I won't take you through all of that, ladies and gentlemen.
Then Mr Hill in cross-examination asked Mr Pullin about the smaller man. He agreed that he said in his statement to the police that he did not get a look at the second male. Mr Pullin said he meant by that, that he didn't see the second offender as having any distinguishing features. He said the policeman didn't do a very good job of taking his statement. He was in an emotional state and that's what he meant; but he agreed with Mr Hill that he didn't in that statement on that Labour Day night make any description of the second offender as to his appearance
He agreed that he only had a fleeting glimpse of the smaller offender. He said that it would have been five to six seconds, something like that, that he saw the smaller offender and he only heard him speak two words.
...
Next, Vanessa Angus, a woman of home duties, said that she on that Sunday had gone into Sportsmart at Noble Park to occupy her free time. She got there at 4 p.m. with her little girl and she was still there when the robbery took place, having browsed around.
'The larger man', she said, 'said , 'Open the till'. He had a stocking over his head with a gun. He was stocky. He was in his 30s.' she, Ms Angus, was carrying her little child at that stage when they were herded up the stairs. She said, 'The other man had a stocking and a gun and it was a revolver. He was younger. He had dark features, undercut.' question, 'An undercut hairstyle?' Answer, 'Yes.' Question, 'Height and build?' Answer, 'Fairly slim but I can't say as to the height.' the older person told the younger one to tape everyone up. She had Tayla, her little three year old with her, and she said this, 'My hands were taped together, my wrists were taped over the top of her', Tayla, 'so she was face down on me.' Ms Angus' ankles were also taped. She was taped by the older man. She said, 'I said to the younger man, 'Don't hurt her', and he', the younger man, 'said, 'No, we won't'.' question, 'How do you describe the manner of the two men?' Answer, 'Fairly calm, I think, professional. Fairly professional, yes.' she said the younger one was told what to do by the older one. She said the younger had a gold, some sort of gold band to tie his hair back. He had dark eyebrows.
In December 2000 she looked at the video of the 12 people and she didn't recognise anybody. She was asked to look at the photo folder. She said, 'I wasn't sure when I picked out no. 7 and 9, more likely 7 because of the eyebrows and the similar features, more the shape of his face and his eyebrows. He had thick eyebrows, dark. That was similar to the young person. It was the hairstyle, hair colouring, just darker features.' that photo folder is number 48, the exhibit before you.
So you appreciate that she just talks about similarity, she doesn't identify the young man himself.
In cross-examination by Mr Dane she said, 'The larger man was 6'2', skinny, mid-30s, slight growth, short light brown or mousy hair. Looked dirty. No accent.'
In cross-examination by Mr Hill she said that the ponytail was tied at the collar, and she said that she had previously said it was about six inches past the collar. She said, 'I remember it as being shorter', but she did agree that's what she had previously said.
Question from Mr Hill, 'It was the eyebrows and the hairstyle that stuck in your mind the most?' Answer, 'Yes.'
