For the reasons given above I am not satisfied that the Panel's determination was affected by error on the face of the record or jurisdictional error. Accordingly, the plaintiff's application will be dismissed.
I request the parties to confer on the question of costs. If the parties are unable to reach agreement on costs within 7 days of the date of this judgment, the proceeding will be relisted for oral submissions on costs.

[31] The body of Dr Blombery's report makes clear that he examined the third defendant on 21 December 2023. The report formed part of the material provided to the Medical Panel. The Medical Panel's certificate and reasons are dated 16 December 2024. It thus appears the correct date of the report is 21 December 2023.
