1 On 16 December 2010 I published my reasons for decision following a trial during September 2010. I dismissed the claims of the plaintiff, Philip Pepe ("Pepe"), against the defendant, Platypus Asset Management Pty Ltd ("PAM"). I reserved the question of costs. The parties exchanged and filed written submissions on costs and requested that I determine the question of costs on the basis of the written submissions which I now do. In substance the plaintiff accepts that the defendant should be awarded its costs and says that the ordinary rule that costs be awarded on a party and party basis should apply. The defendant seeks its costs on an indemnity basis or alternatively on a solicitor and client basis.
