Phillips v RSPCA Victoria (Human Rights) [2018] VCAT 2028
THE PRINCIPLES FOR CONSIDERING SUMMARY DISMISSAL OR STRIKE OUT
A claim which presents no more than a remote possibility of merit or which does no more than hint at a just claim would ordinarily, I think, be found to be lacking in substance.
It may sometimes be sufficient, once the complainant has had every opportunity to identify the subject matter of the complaint and produce all available evidence in support, simply to ask the question whether there is anything of substance which requires an answer from the respondent.
WHETHER THE EQUAL OPPORTUNITY ACT 2010 APPLIES TO THE CLAIM

(2) Subsection (1) applies whether or not the goods or services are provided for payment.
