This matter comes before us by way of an appeal from the decision of Holland J. sitting in the Equity Division of the New South Wales Supreme Court.
By an agreement made on 6th April 1971 the appellant in consideration of the sum of $100 paid by a third party, Liverpool Properties Pty. Ltd., granted an option in favour of that third party to purchase certain real property at Liverpool, New South Wales. The time limit for the exercise of this option was 6th June 1971. The period of the option was subsequently extended for a further six months from 6th June 1971. On 3rd December 1971 the third party nominated the respondent as its nominee in respect of the option and on the same day the respondent notified the appellant that it exercised the option by serving upon him a document entitled "Exercise of Option".
