False or misleading representations about the sale of land
Section 54 guarantee as to acceptable quality
Section 60 Guarantee as to due care and skill
Mrs Pasion - Aarti told us before that you felt ignored by Parminder (Mr Sidhu) regarding the negotiations for the house because he was favouring the other buyer and that you didn't trust what they were saying to you. Is this correct?
Jack - yes, it is correct. I've shown my interest. He didn't ask me if I can offer higher price, later on when I contact him the property already sold (contract signed).
These texts make no reference to the dates Jack is referring to which are critical in this matter.
Mr Sidhu - hi Jack, please call me when you are free. If you are interested in 22 Merivale Drive, please let me know because I don't want you to lose that property. Thanks Parminder
Jack - Hi Parminder thanks and I am working now and can't answer phone call and will contact you later afternoon.
Mr Sidhu -10.47 am - no worries, please call me thanks.
Mr Sidhu -6.34 pm -hi Jack, if you are interested please call me because I have another buyer who is interested to buy this property as he has already given me an offer today. So please let me know if you are not interested, we'll wait for your call thanks.
Mrs Pasion - but you also made deceptive claims saying that there was another interested buyer, and that the house is going get sold tonight if you do not reply to us. But that wasn't the case.
Mrs Pasion - that wasn't the case. No to Jack. You've showed the text message to Harry that day.
Mr Sidhu - that's not. What do you mean it's a deceptive claim?
Mrs Pasion - because that wasn't case. There was no other interested buyer.
Mr Sidhu -and when did I, and when did I send that message?
Mrs Pasion - well you showed Harry that text message that you sent to Jack because Jack was not replying with you.
Mr Sidhu - you know why did I did that? Because you guys pressurise me, you guys given me an ultimatum of 5 o'clock right? Cause I was having a??? Doubt that Reliance might have a different buyer, not this Chinese buyer. That's what I was doing. I was pressurise as well.
A person must not, in trade or commerce, engage in conduct, which is unconscionable, within the meaning of the unwritten law, from time to time.
A person must not, in trade or commerce, in connection with:
(a) the supply or possible supply of goods or services to a person (other than a listed public company); or
(b) the acquisition or possible acquisition of goods or services from a person (other than a listed public company);
138 The Term "unconscionable" is not defined in the FTA or ACL, however, the courts have determined that unconscionable conduct will arise where there is serious misconduct, being conduct that is so against good conscience, that it warrants intervention by a court.
139 To meet this standard, it is not enough for the impugned conduct to be merely "unfair", "unjust" or "unreasonable". Nor is it enough for the transaction to be grossly one-sided. The use by a party of its stronger bargaining power to achieve an unfair or one-sided advantage does not, by itself, lead to a finding of unconscionable conduct. Driving a hard bargain has never been proscribed under either the unwritten law of unconscionable dealing or the statutory law. The courts have observed that commercial conduct of this type is simply capitalism in action.103
140 On frequent occasions, the courts have held that, for conduct to be deemed "unconscionable", the conduct must contain a necessary and distinguishing feature, namely, the taint of "moral obliquy".
