Original judgment source is linked above.
[1] The submissions and evidence of the parties, any supporting exhibits given at the hearing and the statements of grounds filed have all been considered in the determination of the proceeding. In accordance with the practice of the Tribunal, not all of this material will be cited or referred to in these reasons.
[2] It is noted that neither of these referral authorities are parties to the proceedings and that the Head, Transport for Victoria does not object to both proposals because access to Donnybrook Road will remain temporary. It should also be noted that other referral authorities for the subdivision amendment including the APA Group, AusNet Services, AusNet Transmission and Yarra Valley Water all offered no objections with some subject to conditions.
[3] Refer to the Schedule to Clause 72.04.
