Introduction
- In this matter the appellant seeks to leave to appeal from a decision of a member sitting in the Consumer and Commercial Division of the Tribunal (the Tribunal). In proceedings HB 14/24744 the appellant had sought an order for costs in the sum of $1,512.32 in relation to proceedings HB 12/44104 and HB 12/44112 (collectively "the HB proceedings").
- On 23 May 2014 the Tribunal dismissed the appellant's application. It found that:
- it had no jurisdiction to hear and determine the matter;
- even if it had jurisdiction there was no evidence to support the claim for costs; and
- the application was frivolous and vexatious.
- This is a matter in which the appellant requires leave of the Appeal Panel for the appeal to proceed. For the reasons given below, we consider that the application for leave to appeal should be refused, and the appeal dismissed.
