REASONS FOR DECISION
- This is an ex parte interlocutory motion by the respondent Commissioner seeking confidentiality for certain evidentiary material and exemption from the obligation to file and serve certain documents as required by s 58 of the Administrative Decisions Review Act 1997 (ADR Act).
- On 14 May 2021 the applicant Mr Victor J Neubeck applied to this tribunal for review of a decision by an adjudication officer of the respondent made on 27 February 2021 to revoke his category AB firearms licence No. 407112936. The grounds for revocation were that the respondent held information revealing that the applicant had not stored his ammunition safely, and further that he was residing with an individual (his son Liam Neubeck) who was prohibited from possessing firearms pursuant to firearms and weapons prohibition orders (exhibit R1, pp 14 - 19), raising serious concerns for his domestic circumstances.
- The applicant requested an internal review of the decision, but was not notified of the outcome of the review within 21 days, with the result that the review was taken to have been finalized on or about 11 April 2021 in accordance with s 53(9)(b) of the ADR Act.
