A SEISMIC CHANGE IS COMING TO THIS PART OF HIGHETT
IS THE PROPOSED BUILDING CONSISTENT WITH THE OUTCOMES SOUGHT BY DDO12 AND RELEVANT PLANNING POLICY?
The intention in these areas is that new medium density housing comprising a variety of housing types and layouts will be promoted responding to the established but evolving urban character. Because these are already established as residential areas, the design of new medium density housing proposals will need to display sensitivity to the existing residential context and amenity standards in these areas.
Encourage increased residential densities and a wider diversity in housing types and sizes in areas which are within convenient walking distance of public transport and activity centres. These areas are identified for 'increased housing diversity' on the Residential Framework Plan within the MSS.
DESIGN RESPONSE AND OFF-SITE AMENITY IMPACTS TO NEIGHBOURS
The road alignment at the front of a lot. If a lot abuts two or more roads, the one to which the building, or proposed building, faces.
Internal layout including balconies and ground level secluded open space
Roof top deck/communal open space and overall height
The dwelling entries of the ground floor of dwellings and residential buildings should be accessible or able to be easily made accessible to people with limited mobility.
Noise, chimney smoke and other amenity issues
[31] There is undeniably a tension between the present and the future. A tension between what exists and what is to come. A tension between respecting, enhancing and conserving heritage fabric and allowing new development of a quite different scale and character. A tension between the intensity of activities and development within the commercial strip and the adjoining homogenous residential area. Ultimately it is a question of considering these tensions and, as required by Clause 10.04 of the Planning Scheme for me to:
endeavour to integrate the range of policies relevant to the issues to be determined and balance conflicting objectives in favour of net community benefit and sustainable development for the benefit of present and future generations.
[32] It is on that basis that I have come to the conclusion that the proposal does provide a net community benefit and that it is worthy of support.
Construction of a three storey apartment building containing not more than 24 dwellings in the General Residential Zone (GRZ2) and Design and Development Overlay (DDO12) in accordance with the endorsed plans.
Drainage and Water Sensitive Urban Design (WSUD)
Parking areas and access lanes must be kept available for these purposes at all times and maintained to the satisfaction of the Responsible Authority.
In accordance with Section 69 of the Planning and Environment Act 1987, an application may be submitted to the Responsible Authority for an extension of the periods referred to in this condition.
[1] I have considered the submissions of all the parties that appeared, all the written and oral evidence, all the exhibits tendered by the parties, and all the statements of grounds filed. I do not recite or refer to all of the contents of those documents in these reasons.
