- In this proceeding, issued by writ, the plaintiff sought an injunction, both interlocutory and permanent, to restrain the publication by the defendant of libellous material, together with damages. The plaintiff issued the writ on 12 May 1997. It obtained an interlocutory injunction, ex parte, from Beach J, on 12 May 1997, restraining the defendant from publishing the alleged defamatory material. The parties appeared before His Honour on 19 May 1997, and His Honour continued the injunction and adjourned the application to 16 June 1997, when Chernov J granted an injunction pending the determination or further order. The defendant did not appear on the return of the summons before Chernov J, who ordered him to pay the costs of the day.
