REASONS FOR DECISION
- These reasons relate to two appeals of a decision from the Consumer and Commercial division of the Tribunal. An appeal was filed by the builder on 3 July 2020 and a subsequent appeal was filed by the homeowner on 10 July 2020.
- The parties entered into building contract for the construction of a dwelling on 14 December 2011. The homeowner made an application to the Tribunal on 13 December 2018 seeking orders for defective and incomplete works. The Tribunal decision was made on 1 May 2020 and orders were made for the builder to pay the homeowner a sum of $33,461.78. A further decision was made by the Tribunal on 11 June 2020 in relation to costs. An order was made for the builder to pay the homeowner's 'costs of and incidental to the limitation defence issue raised by it for the period 14 February 2019 to 4 March 2020 on the indemnity basis'. In relation to the balance of the proceedings, the Tribunal ordered that the builder was to pay the homeowner costs of the proceedings as agreed or assessed.
