LOTT v JBW & FRIENDS P/L & ENDEAVOUR CORP DESIGN No. SCGRG-99-679 [2000] SASC 3 (24 January 2000)
Respondents graphic designers engaged to prepare brochure promoting entertainment event - brochure cover featured a distinctive graphic design illustrating the name of the event - produced with the aid of design software - creative effort and input by designers - graphic subsequently reproduced in newspaper advertisements without designers' permission - held that the graphic is an artistic work in which copyright subsists. Appropriation of substantial part of original work - no basis upon which to imply a licence to reproduce the graphic as a term of the contract between the parties - liability of appellant as director for infringement by company - test to be applied. Damages - measure of damages - compensatory damages limited to amount of appropriate charge for use of copyright material - additional damages for flagrancy of infringement reduced.
