Reasons for the Decision
- This is an internal appeal from a decision of the Consumer & Commercial Division of the Tribunal. The proceedings concern an application to terminate a residential tenancy agreement pursuant to s 92 of the Residential Tenancies Act 2012 (the RT Act). The appeal was lodged on 27 November 2015. Mr Lindsay, the tenant, is appealing the following orders, made on 12 November 2015: 1 The tenancy is terminated immediately in accordance with s 92 of the Residential Tenancy Act 2010. 2 The order for possession is suspended until 10 January 2016.
- Termination was sought after an incident which had occurred on 15 May 2015, in which it was alleged Mr Lindsay attended the offices of the respondent and threatened two of the respondent's staff.
