Legal Profession Act 2004: professional misconduct: solicitor representing himself in family law proceedings; four affidavits filed containing intemperate, provocative and offensive language
Legal Services Commissioner v Johnson (Legal Practice) [2012] VCAT 1426
Mr Johnson is found guilty of two charges of professional misconduct.
REFERRAL TO THE LEGAL SERVICES COMMISSIONER BY FEDERAL MAGISTRATE
I apply to the Victorian Civil & Administrative Tribunal (the Tribunal) pursuant to section 4.4.13(2) of the Legal Profession Act 2004 (the Act) for an order under Division 4 of Part 4.4 of the Act in respect of the Respondent.
(a) at all material times the Respondent was an Australian legal practitioner within the meaning of the Act, alternatively a legal practitioner within the meaning of the Legal Practice Act 1996 (Vic) (1996 Act), having first been admitted to practice in 1990; and
(b) a local legal practitioner within the meaning of the Act, alternatively a current practitioner within the meaning of the 1996 Act.
(i) Federal Magistrate O'Dwyer had engaged in improper conduct during various hearings, was [guilty of] misconduct, and was corrupt (Annexure 5, page 13, paragraphs 21 to 23 page 26 paragraph 29.4.v.1, page 28 paragraph 29.5, page 30 paragraph 29.10-11, page 39 heading to paragraph 35);
(ii) Justice Cavanough (who presided over the Practice Court at one stage during the property litigation in the Supreme Court) and other unnamed judges of the Supreme Court were patently biased, prejudiced and [guilty of] improper conduct (Annexure 5, page 13, paragraph 20);
(iii) counsel for Ms Cressy, Mr Graham Devries, was unethical, corrupt, had deliberately misled Federal Magistrate O'Dwyer and/or judges of the Practice Court in the Supreme Court, had been a party to procuring affidavit material from a witness knowing it to be false and was not a fit and proper person to be a member of counsel (Annexure 16, page 2 paragraph 2, page 9 paragraph 11, page 29 paragraphs 48-49, page 24, paragraphs 36 and 37; page 32, paragraph 52, sub-paragraph b; page 36, paragraph 56); Annexure 5 page 21 paragraph 28.4.b, paragraph 29.4.v.1, page 27 paragraph 29.4.v.3.iii, page 31 paragraph 29.13c, Annexure 15 page 9, Annexure 17 page 3 paragraph 5);
(iv) solicitors acting for Ms Cressy (in the family law and/or property proceedings) and/or those acting for the children were unethical, self-interested, corrupt, blackmailing individuals, some of whom had procured affidavit material from a witness, knowing it to be false (Annexure 5 page 4 paragraph 4.c, page 5 paragraph 5.d, page 8 footnote 8.2, page 10 paragraph 12 page 12, paragraphs 17 and 19, page 16, paragraph 8, sub-paragraph c iii-v)-page 21 paragraph 28.4.b, page 38 paragraphs 33-34, page 59 paragraph 39, Annexure 15 paragraph 9, Annexure 16 page 2 paragraphs 2, 2A heading and CA.c, page 17 heading to paragraph 18, Annexure 17 page 3 paragraph 5)
Following an investigation I am satisfied that, in the circumstances, there is a reasonable likelihood that the Victorian Civil and Administrative Tribunal will find the Respondent guilty of professional misconduct. Pursuant to section 4.4.13(2) of the Act I now make application to the Victorian Civil and Administrative Tribunal for determination of the following charges and consequential orders:
Professional misconduct being misconduct at common law and within the meaning of section 4.4.3(1) of the Act, in that the Respondent's conduct would reasonably be regarded as disgraceful and dishonourable by legal practitioners of good repute and competency.
I refer to and repeat the allegations set out in paragraphs 13-16.
Further, or in the alternative to Charge 1, professional misconduct within the meaning of section 4.4.3(1)(b) of the Act, by engaging in conduct, otherwise than in connection with the practice of law, that justifies a finding that the Respondent is not a fit and proper person to engage in legal practice.
I refer to and repeat the allegations set out in paragraphs 13-16.
Professional misconduct within the meaning of section 4.4.4(a) of the Act in that, contrary to Rule 21 of the Professional Conduct and Practice Rules 2005, in all his dealings with other practitioners, the Respondent failed to take all reasonable care to maintain the integrity and reputation of the legal profession by ensuring that his communications were courteous and that he avoided provocative language or conduct.
I refer to and repeat the allegations set out in paragraphs 13-16.
You are referred to Divisions 4 and 5 of Part 4.4. of the Act.
NOW TAKE NOTICE that pursuant to Section 4.4.15 of the Act this Application will be heard and determined by the Victorian Civil and Administrative Tribunal at a time and place appointed in writing by the Tribunal.
In passing I might comment, considering specifically the abovementioned letter penned by Mr David Hanlon, that never prior to these set of proceedings in which I am client, solicitor and advocate (and not by choice any of the three), never have I in all of the 18 full years since I swore my oaths of allegiance and admission and become a Barrister and Solicitor of the Courts of this State and this Federation, have I come across so many lawyers, and I single out for specific mention Mr David Hanlon of Harwood Andrews, Mr Richard Ingleby of the Victorian Bar and Mr Graeme DeVries of the Victorian Bar (professional misconduct complaints pending) who are so freely and gleefully willing to tell outright lies notably to Supreme Court Justices, to advance any client's case. This is perhaps all the more astonishing given the obvious lack of character and credit in the First Respondent's disposition and methods. Or perhaps, lies being part of the First respondent's stock in trade, her legal counsel past and/or present have been contagioned or simply are not wanting to be outdone by her in that regard either?
Mr Justice Cavanough's head was no doubt ringing, as was my own, from over three and a half hours of malicious and deliberate falsehoods he had heard from the mouth of that most unethical, disgraceful and disgusting man, the Plaintiff's Counsel, Mr Graham Devries.
If ever any barrister or solicitor deserved to be struck off the roll of this Honourable court and/or imprisoned (or both) for contemptuous, unethical and disgraceful conduct, then the Plaintiff's Counsel, Mr Graham Devries is that man.
Mr Devries' conduct during these proceedings provides all the substantiation needed for these claims. That man has a reputation amongst other barristers for being 'slippery'. Clearly, his peers speak in euphemism and not merely in understatement. I have documented already in these proceedings many incidents of 'slippery' conduct by this man. I refer at this point to Exhibit HJJ-31 [within Exhibit JHH11-1 of this my Affidavit] and in particular (but without limitation) to my comments in paragraph 4 beginning on page 2 thereof which lists 4 disgraceful examples of Mr Devries contemptuous unethical and disgraceful conduct. I shall return to this theme and describe further instances presently.
As a legal practitioner and humble officer of this Court of 18 years good standing, it grieves me to speak so forthright and unfavourably about two legal practitioners, Mr James Turnbull and Mr Graham Devries. I say this in all honesty even though I have noted how Mr Devries in particular so relishes every opportunity to spread malicious and deliberate falsehoods about me, not to mention partaking with relish in outrageously disgraceful court room dramatics as I have described in previous materials I have filed in these proceedings and to which I will return to later in ... this Affidavit.
I thought that David List, being a mental health care professional, a healer, might be able to provide some help to Pippin and the children. But he turned out to be an egotistical monster, totally unethical and unprofessional. He broke more APS Guidelines in writing his report than he actually managed to keep. I question his sobriety and even his sanity, as I believe he got a perverse sexual kick out of writing up Pippin's mad lies about me (no, I'm not an incestuous paedophile since my teens) in retaliation to my telling David List Pippin's history, 'in confidence'...
The corrupt Family Report written by David List (and dare I say substantially the conduct of Ms Cressy's and his evil imaginations), needs to be completely re-done by a competent and ethical (and dare I say, sober and sane) psychologist.
[Dr List's] report was professionally fraudulent, and ... Dr List is gaining a reputation for such travesties, and that I would when I get the breath to do it be making a full complaint to the Psychologists Registration Board. I see the Family Report needs to be completely done by a competent and ethical professional.
Senior family and Supreme Court lawyers consulted about the case are stunned and outraged by the Judges' conduct in granting these orders.
Poor RICHARD [an alias for Mr Johnson himself] is in hiding, fearful for his life. He will not be attending Court this morning. 'There's no point me even showing up'. He says. There's been no trial. There's no evidence. There's barely any pleadings. Nothing. There's no point me turning up. I may be a lawyer of 18 years good standing But the Judges don't even let me speak in my defence. I'm told that I'm guilty. And I'm told that I'll be physically removed from the Court if I sigh too loudly, let alone if I dare try to speak up.
A woman who is herself the victim of the self-interest, greed and incompetence of her own legal advisers (so called accredited family law specialists) exploiting her madness thinking they can pull a few easy hundreds of thousands of dollars out of me for the troubles they have caused.
The greed and avarice of blackmailing family law specialists looking after only their own profit making interests, without regard to (and even actively to the detriment of) the welfare of their own clients...
had much explaining to do to justify their self-interested, conflicted and grossly negligent advices to Pippin and their unethical and unlawful actions against me, a senior member of the legal profession, in these proceedings ...
I have filed formal requests for parliamentary and executive inquiry into the fitness for office of Mr Justice Cavanough of the Victorian Supreme Court, and for inquiry into several other Supreme Court Judges, having regard to his/their improper conduct and acquiescence in the abuse of Supreme Court rules and procedures, including the patently biased, prejudiced and improper conduct of Mr Justice Cavanough sitting in the Practice Court Division for a full day (I kid the litigation lawyers and justices not) on Friday 20 June 2008.
I have filed a formal request for parliamentary and executive and judicial inquiry into the fitness of FM O'Dwyer to hold judicial office, having regard to his improper conduct, prejudice and bias in hearings in these Federal Magistrates Court proceedings on 1 May 2008, 28 May 2008, his 'hearing' (if indeed it was one) of Pippin's lawyers ex parte on 18 July 2008, and the hearing on 21 August 2008.
I am shocked that FM O'Dwyer did not transfer this matter to the Family Court proper as I submitted to him on 21 August 2008.
I am shocked that FM O'Dwyer did not disqualify himself from any further involvement in these proceedings, having regard to my concerns that he has demonstrated bias, prejudice and other improper conduct, perhaps amounting to corruption in the hearings in May, July and August this year.
What is clear is that Johnson believed he could turn the hearing of the misconduct charge against him into some sort of media event at which numbers of people, many of them prominent, would be questioned about matters having absolutely no relationship to the professional misconduct charge faced by Johnson. Indeed, in other parts of [Mr Johnson's] blog, he has referred to there being between 100 and 200 witnesses and to the 'trial' lasting some three months. The abuse of process involved in the issuing of subpoenas for this reason is patent.
He also ordered that neither Mr Johnson nor any of his agents are to request the Principal Registrar to issue a witness summons without first obtaining the direction of the Tribunal. Written reasons for this ruling were provided on 30 May 2012.
Obviously, I am keen to get the ball rolling with counsel and with instructing solicitors, as quickly as possible. Even with the "trial date" put back to 3 December 2012, incoming solicitors and counsel will have a lot of work to do to get on top of thousands of pages of transcripts and documents and almost 5 years of legal, bureaucratic and other government processes that has been going on concurrently (including Federal and State courts).
The question is not whether it is unfair, in some colloquial sense, for the inquiry to proceed with the respondents unrepresented. The question is whether fairness dictates that the enquiry may not proceed unless the respondents are represented by counsel. ...[10]
The principle established by [Dietrich] as to the use of a Court's inherent powers to stay or adjourn proceedings until legal representation is obtained, where it concludes it is necessary for a fair trial, refers only to criminal proceedings: New South Wales v Canellis [1994] HCA 51; (1994) ALR 513; 522; Williams v Official trustee [1994] FCA 1194; (1994) 122 ALR, 585,600. It is not authority for the proposition that in other proceedings or inquiries adjournment of proceedings would be required by the dictates of fairness, even where someone faced potentially serious consequences.
A person charged with a criminal offence or a party to a civil proceeding has the right to have the charge or proceeding decided by a competent, independent and impartial court or tribunal after a fair and public hearing.
I gained the impression that [Mr Johnson ] at the least, is a very intelligent person. He has a quick and incisive intellect. In fact, for a person who professes never to have practised in Court before, he displayed a number of skills of a natural advocate.[14]
...it is probably not advisable for you to act for yourself in a matter like this. It is clear enough from the brief that you are fairly passionately involved, and that generally gets in the way if you are both client and solicitor.
(d) must conduct each proceeding with as little formality and technicality, and determine each proceeding with as much speed, as the requirements of this Act and the enabling enactment and a proper consideration of the matters before it permit.
My defence will of course be de facto a reverse prosecution- or more correctly an inquest of sorts- exposing the industrial scale of this government misconduct and corruption at the intersection of the legal profession and all three branches of government.
97 Further, Mr Johnson would be entitled to recover his legal costs of acting for himself if an order in his favour was made, and these were able to be properly quantified.[20]

[2] At the hearing before me on 3 September 2012, Mr Hannigan (who attended in support of Mr Johnson- see below) made a statement which sought to explain that Mr Johnson did not in fact receive notice of the hearing on 17 May 2012, and how this came about. Mr Hannigan said he is the proprietor of the Cheesecake Factory at 236 Smith St Collingwood. This was the street address specified by Mr Johnson in his letter to the Tribunal of 20 February 2012 (and confirmed by him at the hearing on 21 May) as his address for service. However, whatever occurred in relation to service prior to the hearing on 17 May 2012, has now been overtaken by the subsequent opportunities which Mr Johnson was given to seek to summons witnesses who could give evidence at the hearing.
[4] When pressed as to whether he was making an application for an adjournment Mr Johnson first turned around to the people sitting in the hearing room behind him, and asked, "Shall I make an application?" He then turned back round to face the Tribunal and said, "Yes, let's make an application. I think we ought to cool down. It will certainly help me if I can spend my three days with some time up in Spring Street rather than King Street. Yes, I'll make the application, sir"
