Judgment (10 paragraphs)
Introduction
- On 11 March 2021, a member sitting in the Consumer and Commercial Division of the Tribunal made orders (the Orders), the effect of which was to require the respondent who was the tenant to pay the appellant who was the landlord the sum of $250.00 for carpet cleaning. The member dismissed the claim for damage to the dishwasher integrated panel.
- The landlord appeals, and seeks leave to appeal, against the Orders. Her central contention is that the Tribunal should have ordered the tenant to pay her $592.00 for the repair of damage to the dishwasher integrated panel. For the reasons set out below, leave to appeal is refused and the appeal is dismissed.
The background
- On 31 August 2018, the parties entered into a residential tenancy agreement in respect of premises at Lane Cove (the premises).
- On 24 October 2020, the tenant gave vacant possession of the premises to the landlord.
