Introduction
- This is an internal appeal under s 80(2) of the Civil and Administrative Tribunal Act 2013 (NCAT Act) against a decision made in the Consumer and Commercial Division of the Tribunal on 13 June 2023. The decision related to a residential tenancy agreement concerning an art gallery in Leacock Regional Park.
- On 19 August 2002 the respondent granted a licence agreement to the appellant to live in the premises. The parties agree that the licence agreement is a residential tenancy agreement as defined in the Residential Tenancies Act 2010.
- The internal appeal was brought by the tenant against NSW National Park and Wildlife Service (the landlord). The tenant appeals the decision of the Tribunal to terminate the tenancy and to give possession to the landlord.
- For the reasons set out below we have decided to dismiss the appeal and to affirm the order for termination, extending the order for possession by a further 45 days from the publication of these written reasons for decision.
- For convenience we shall refer to the appellant as the tenant and to the respondent as the landlord.
