Section 149 of the Victorian Civil and Administrative Tribunal Act 1998; stay; enforcement order; rehabilitation of land; Land restoration plan.
Kingston CC v Lantrak Developments Pty Ltd [2020] VCAT 1181
Mr Miles Tehan of counsel, assisted by Mr James Bell and Ms Angela Nunn of Department of Jobs, Precincts and Regions.
(1) The Tribunal, on the application of a party or on its own initiative, may stay the operation of any order it makes pending the determination of any appeal that may be instituted under this Part.
(2) The Tribunal may attach any conditions it considers appropriate to a stay of an order under subsection (1).
The use hereby permitted shall be operated at all times in accordance with the approved working plan and the approved working proposal attached to Extractive Industry Licence No. 716 issued under the Extractive Industries Act 1966.
What are the relevant factors to be considered?
...the prospects that the appeal will be successful, the balance of convenience, and any prejudice that will flow to either party from granting or refusing the stay. As a general proposition, the respondent should not lightly be denied the 'fruits' of his success before the Tribunal. It is clear that the onus rests upon the party seeking the stay.[5]
Prima facie, a successful party is entitled to the benefit of the judgment obtained below and the presumption that the judgment is correct. The applicant for a stay therefore bears the onus of demonstrating that a stay is justified.
...an applicant for a stay...must show special or exceptional circumstances to take the case out of the general rule that an appeal does not operate as a stay.
...Adam J recognized that special circumstances might exist where a successful appellant would be deprived of the fruits of the appeal if a stay of execution were not granted. In such a case, the appeal might be rendered nugatory.
...Young CJ stated that special circumstance would 'exist where for whatever reason, there is a real risk that it will not be possible for a successful appellant to be restored substantially to his former position if the judgment against him is executed'.
The prospect that the appeal may be rendered nugatory must be balanced against the principle that the successful party is entitled to the fruits of the judgment. A stay should not be granted unless there is at least an arguable ground of appeal, although otherwise speculation as to the ultimate prospects of success is usually inappropriate.[6]
In summary, the factors relevant in considering whether to order a stay of the decision below are the prospects of an appeal being rendered nugatory, the balance of prejudice in depriving a party of the fruits of judgment against the risk that an appeal might be rendered nugatory, and the prospects of success of the appeal.[7]
What is the prejudice to the Council if the stay is granted?
[1] The submissions of the parties, any supporting exhibits given at the hearing and the statements of grounds filed have all been considered in the determination of the proceeding. In accordance with the practice of the Tribunal, not all of this material will be cited or referred to in these reasons.
