Judgment
- HER HONOUR: This is an application for substituted service, reinstatement of a company and ancillary orders pursuant to section 601AH(3)(d) of the Corporations Act 2001 (Cth) that, upon the reinstatement of the company, contrary to the position at deregistration: 1. the plaintiff is to be the sole shareholder of the company, holding all 100 shares; 2. the plaintiff is to be appointed sole director and secretary of the company; 3. the registered office of the company is to be the plaintiff's home address; and 4. the constitution of the company is to be dispensed with.
- The plaintiff's counsel accepts that, by this application, he seeks ancillary orders on reinstatement which are wide reaching and unusual, but contends that these are unusual circumstances.
