Background
- This is an appeal from a decision made by the Tribunal in the Administrative & Equal Opportunity Division published 24 March 2023 (the "Decision") by which the Tribunal affirmed a decision by the Respondent to refuse the Appellant's application for accreditation as a high-risk work licence assessor under the Work Health & Safety Act 2011 ("the Act") and the Work Health & Safety Regulation 2017 ("the Regulation").
- The background facts are as follows: 1. The Appellant had formerly held a high-risk work licence issued in Queensland until 2012. 2. The Appellant was granted a NSW high-risk work licence in respect of certain categories of work, namely Rigging Intermediate, Boom Type Elevating Platform, Forklift Trucks, Dogging and Basic Rigging issued on 25 November 2020, and Slewing Mobile Crane (up to 60 tonnes) issued on 5 January 2021, and Bridge and Gantry Crane issued on 16 February 2022. 3. The Appellant had completed a Certificate IV in Training and Assessment issued by TAFE on 22 July 2021. 4. On 18 February 2022, the Appellant submitted an application for accreditation as an assessor for high-risk work licence in the classes of Rigging Intermediate, Slewing Mobile Crane (up to 60 tonnes) and Boom-type Elevating Platform. The supporting material included evidence of the Appellant's operational experience between 2002 and 2008 as well evidence of experience gained from January 2022. 5. The parties engaged in correspondence concerning the application and, on 27 May 2022, the application was refused under clause 118(2)(a) of the Regulation. 6. Thereafter, the Appellant made an application to the Tribunal for review of the decision by the Respondent. As indicated above, the Tribunal published the Decision on 24 March 2023, by which it ordered that the decision under review be affirmed. 7. On 19 April 2023, the Appellant lodged a Notice of Appeal in respect of the Decision.
