ANNEXURE A - FORM OF PROTECTIVE ORDERS PROPOSED BY HCCC
HCCC's Position on Protective Orders 1. Suspension of the respondent's registration pursuant to s149C(c) of the Health Practitioner Regulation National Law (NSW) for a period of 6 months. 2. Upon the expiration of the suspension of the registration, the respondent's registration is subject to the following practice conditions pursuant to section 149A(1)(b) of the Health Practitioner Regulation National Law (NSW): a. To forward evidence to the Nursing and Midwifery Council of NSW within seven (7) days of the date of the decision, that the practitioner has provided a copy of this decision to her employer/s (if any). b. Within seven (7) days of a change in the nature or place of practice, the practitioner is to forward evidence to the Nursing and Midwifery Council of NSW that she has provided a copy of this decision to the nursing employer/s. c. The practitioner must engage in a mentoring relationship for a period of at least 12 months with a registered nurse (Division 1) approved by the Council who does not have conditions on their practice. d. To comply with condition (c), the practitioner must: i. nominate a mentor for approval by the Council, within 21 days of recommencing practice as a nurse. ii. provide to the Council, within 14 days of the mentor being approved, a copy of the Tribunal's decision, including orders made, that has been signed by both the practitioner and by the mentor indicating awareness of the decision and orders. iii. submit a mentoring plan developed in consultation with the mentor within 4 weeks of the mentor being approved by the Council. The mentoring plan must include a focus on the professional obligations of honesty and integrity. iv. attend meetings with the approved mentor at least but not limited to once weekly for the first three months and thereafter meetings can be reduced to once monthly. The mentoring report is to be co-signed by the approved mentor and must meet the standards required by the Council. e. The practitioner is responsible for the costs associated with complying with the conditions unless otherwise specified. f. The Nursing and Midwifery Council is the appropriate review body for the purposes of Division 8 of the Health Practitioner Regulation National Law (NSW). g. Sections 125 to 127 of the Health Practitioner Regulation National Law are to apply whilst the practitioner's principal place of practice is anywhere in Australia other than in New South Wales, so that a review of these conditions can be conducted by the Nursing and Midwifery Board of Australia.

Not to be the nurse in charge of any shift, ward or unit. b. Not to work as the sole practitioner on any shift. c.
