The Applicant knew, at the time of filing the application for the Trade Mark, that the Opponent was the owner of the Prior Mark and/or was using the Prior Mark in connection with the goods in class 21.
As of 26 February 2025, the Applicant is an individual with no known residential or business address in Australia but is the owner or applicant of 87 Australian trade marks covering a broad and diverse range of goods and services, 83 of which were filed in 2024.
The absence of any use or demonstrated intention to use the Trade Mark in Australia or other jurisdictions strongly suggests that the Applicant's registration of the Trade Mark is not bona fide.
The Applicant's conduct in adopting "Koythin" as a trade mark indicates an intention in bad faith to:
(a) piggy-back off the Opponent's goodwill and reputation in the Prior Mark to generate interest in relevant goods, which in turn is diluting and damaging, or will dilute and damage, the Opponent's goodwill and reputation in the Prior Mark;
(c) disrupt or negatively affect the Opponent's business and the Prior Mark.
The conduct of the Applicant falls short of the standards of acceptable commercial behaviour observed by reasonable and experienced persons (DC Comics v Cheqout Pty Ltd and Another [2013] FCA 478; (2013) 299 ALR 110, at [77]). A reasonable person standing in the Applicant's shoes would have been aware that he/she ought not to apply for registration of the Trade Mark.
(1) Unless subsection (3) applies to the proceedings, the Registrar must, at the end, decide:
(b) to register the trade mark (with or without conditions or limitations) in respect of the goods and/or services then specified in the application;
having regard to the extent (if any) to which any ground on which the application was opposed has been established.
