Mr J
Original judgment source is linked above.
The applicant sought a review of a decision made by the Central Assessment Unit to prohibit the applicant from working with children pursuant to s 32 of the Child Safety (Prohibited Persons) Act 2016. The prohibition notice was issued on the basis that the applicant was presumed to pose an unacceptable risk to children because of his conviction for a presumptive disqualification offence under s 26A of the Act.
The applicant made submissions in mitigation regarding the circumstances of the offending and argued that the offence should be disregarded on account of these circumstances. The applicant further submitted that exceptional circumstances exist in that he has not used marijuana since 2014 and consequently, he no longer poses an unacceptable risk to children.

The process followed by the central assessment unit

the central assessment unit must determine the person poses an unacceptable risk to children and should be prohibited from working with them. (4) A working with children check must be conducted in accordance with any other requirements set out in the regulations and the guidelines (however, a failure to comply with this subsection does not, of itself, invalidate a working with children check).
