The applicant, Mr Ireland, sought a review of a decision of the Department of Human Services - Central Assessment Unit to issue a prohibition notice against him, prohibiting him from working with children pursuant to s 15(1)(a) of the Child Safety (Prohibited Persons) Act 2016 (the Act). Mr Ireland had been convicted of a presumptive disqualification offence in trafficking a controlled drug. Mr Ireland did not make any submissions to the Department on these matters.
Mr Ireland submitted there were exceptional circumstances surrounding his disqualifying offence that meant he does not pose an unacceptable risk to children. He submitted he had difficulties during childhood that resulted in his leaving school early. Having few skills, he experienced long-term unemployment culminating in the disqualifying offending. Mr Ireland advised that his arrest and conviction had been life changing and he has since turned his life around, having undertaken community service, obtained employment, and started his own business.
The respondent submitted it was not sufficient for Mr Ireland to demonstrate that he did not pose an unacceptable risk to children, but that he must establish exceptional circumstances surrounding his offending.
The Tribunal, accepting Mr Ireland's submissions regarding the substantial changes in his circumstances and lifestyle since his conviction, was satisfied that Mr Ireland has established that exceptional circumstances exist such that he does not pose an unacceptable risk to children. The Tribunal however accepted the respondent's submissions regarding the meaning of "exceptional circumstances" in s 26A(1)(c)(ii).
The decision subject to review, namely the Department's decision of 26 September 2019 to issue a prohibition notice prohibiting Mr Ireland from working with children on the basis of a presumptive disqualification offence, is set aside.
