- The applicant became aware that the respondent's mother had passed away, that the respondent was residing in the property and that she did not intend to return the keys. In response, on 19 May 2010 the applicant served a notice to vacate on the respondent as her mother's next of kin. That notice, served under section 228 of the Residential Tenancies Act 1997 ("RT Act"), had the effect of bringing the respondent's mother's tenancy to an end.
- As the respondent continued to stay in the property, on 4 August 2010 the applicant made an application to the Tribunal for a possession order under section 344 of the RT Act. The application was made on the basis that the respondent was not a tenant under a tenancy agreement and she was occupying the Keilor Downs house without the applicant's licence or consent.
