Director of Consumer Affairs Victoria v Hoban (Amended) (Review and Regulation) [2016] VCAT 1322
The allegations and statement of agreed facts
These three questions must be capable of being answered because the trust account holds other people's money;
Determinations under section 25 of the Act
I determined that Mr Hoban, as officer in effective control,
Having regard to the signed statement of agreed facts dated 31 July 2015 and the evidence heard, the Tribunal finds that the respondent has:
(a) Failed to comply with section 29B(2)(e) of the Act and regulations 11, 13(1) and 13(2) of the Estate Agents (Professional Conduct) Regulations 2008; and
(b) Is not a fit and proper person to hold a licence; and
(c) Has been guilty of conduct as an estate agent which renders him unfit to hold a licence.
[1] These reasons for decision were amended by order made on 16 September 2016 - see Director of Consumer Affairs Victoria v Hoban (No 2) [2016] VCAT 1574.
[2] CAV also brought a proceeding against the company (proceeding Z208/2015) and on 14 April 2016, I made findings about allegations relevant to the company. On 14 June 2016, I struck out that proceeding after being informed that the company had been placed into external administration in December 2015 and, as a consequence, the Tribunal was unable to make final orders as no court has given leave for that proceeding to continue as required by section 500(2) of the Corporations Act 2001 (Cth).
