Section 94 makes it an offence to contravene or fail to comply with any provision of the Act or Regulations.
(a) Statutory Trust Account number 1841-77555, in the name of Colin Rounds Real Estate P/L 'Rental-Statutory Trust Account'; and
(b) Statutory Trust Account number 9038-28634, in the name of 'Colin Rounds Real Estate Pty Ltd, T/As Rounds Real Estate'.
My own impression of him was that he had multiple diagnoses with mixed features of anxiety and major depression, and appeared to have a dependent personality.
Dr Jenshel prescribed anti-depressant medication. He confirmed that his experience with the hair loss medication is that it can lower the mood of patients, and it is possible this worsened the severity or complicated the management of Mr Rounds' depression. Dr Jenshel's report went on to describe the numerous personal financial and work related difficulties which Mr Rounds had experienced. Dr Jenshel then commented on the circumstances of Mr Rounds' taking money from his trust account in this context. The report stated
I liken his actions to someone battling hunger in a war zone where survival had become the only option. When that person steals a loaf of bread to survive, it is a sign of the desperate situation they are in, and may not be proof of a criminal disposition.
He said that from his consultations with Mr Rounds, he never had the impression he was a dishonest person. He said Mr Rounds was very remorseful.
[1] The reference to regulation 13(4) appears to be an error and so I have taken no account of it in dealing with this application.

[4] In his affidavit of 20 September 2003 Mr Rounds said that he stopped taking Proscar in late 2012, however the other evidence, suggests he went off Proscar in late 2011. Nothing turns on this for the purposes of this decision, however.
