REASONS FOR DECISION
- These proceedings were commenced by an application for disciplinary findings and orders (the Application) lodged by the Applicant (the Council of the Law Society of New South Wales) on 18 December 2023 against the Respondent (Mr Buckley, a solicitor). The Application alleges that the Respondent engaged in unsatisfactory professional conduct or professional misconduct and the Applicant seeks orders pursuant to s 302 of the Legal Profession Uniform Law (NSW), costs and such other orders as the Tribunal deems fit.
- The Respondent filed a Reply on 30 January 2024 contending that the Tribunal does not have the jurisdiction to determine the Application. Subsequently on 12 February 2024 the Respondent lodged a "General application" in which the Respondent contended that the Tribunal does not have jurisdiction to determine the Application and seeks an order that the Application be dismissed.
- The Applicant's Application has not yet been heard and determined and therefore, if the Respondent's application for dismissal of the Application is unsuccessful, it will be necessary to make directions for the filing and serving of any further evidence and/or submissions which either party may wish to make and to set the proceedings down for a final hearing.
- However, it is firstly necessary to consider and determine the Respondent's application for dismissal and therefore to set out the nature of the Application and the Respondent's contentions with respect to that Application.
